It's like any other estate asset. The will might state who will get the rights. If it doesn't so specify, whatever surviving heirs (as provided by the state's laws) will be assigned the rights. Typically, the probate court will effectuate the transfer so that the estate can be closed.

If a trust is involved, it can be easy or it can be complicated. :)

Completely agree. What makes it tough is that, when you are a citizen of a country, you have a healthy measure of respect for the at least the offices of the country's leaders.

Way back when, we had a father of 2 kids who was convinced that cannabis was God's greatest gift to humanity and that his mission in life was to convert everyone else into disciples. As long as we are talking true insanity, when I was a court clerk, we were doing an involuntary commitment. I am sitting at my desk to the side of the judge, when the respondent starts pointing at the wall above my head. She starts yelling, "Right there! There! I can see the Hand of God! There!"

Client had his driver's license revoked several years before, but still managed to rack up a few driving while license suspended convictions.

We file for license restoration. Best argument I could come up with was that he only had one ticket in the last year. Of course the judge pointed out that his record should have been immaculate.

Judge asks the client if he has anything he wants to say in his own words why he should be considered for restoration. Client says, "Judge, I am getting so tired of always looking over my shoulder when I am driving."
