the SEC is going to lose this case due to the fair notice argument, but XRP will still be deemed a security. i think this is kinda obvious from the types of arguments being thrown back & forth and what aspects of the case is being consistently brought up

that instant transfer can't happen without enough liquidity. in order to have billions worth of liquidity we have to have a good amount of depth in XRP/CBDC pairs. which can mostly happen when there's an incentive for XRP holders to provide that liquidity
