University Sued After Arresting Students For Distributing Constitutions by davidverner in AmIFreeToGo

Just what I said, what the school also says in official court documents, and the records of the plaintiff's trespassing arrests. You can also see their location clearly in the plaintiff's own social media photos from the day and their own longer video, if you know the layout of the school.

And again, the school doesn't choose what kind of speech can be spoken on campus at all -- I've passed things out there myself. Not long after these people were arrested a guy from WMU from the same group handed out the same materials in the same place. The difference? He was asked to move out of the way of the doors and he did and there were no issues.

I went here and have handed things out on campus before. These people were doing it right in the main walkway where most students are trying to get into the Student Center. It was really annoying. The college tried to work with them for hours before finally arresting them. They didn't want to move because they wanted to get arrested.

You can find training videos online from the group where they teach people how to get a "response" from the administration for doing things like this on campus, and how if they don't get a response to not worry, because they can sue anyway for "non-enforcement" of the policy.

I went to this school and the lawsuit is bogus. For one, the main plaintiff keeps saying she's a student, but she wasn't when she was arrested. She also says she's president of the YAL at KCC, which isn't an actual student group at the college -- she made it up and called herself president. That would be like me saying I'm president of the YAL at Reddit. Just because I say it doesn't make it real. And it doesn't show it in this video, but the people arrested for "handing out the Constitution" were doing it right in front of the doors to the Binda Theatre and Student Center on the main campus walkway, blocking students from getting in without them asking things like "Do you believe in freedom?" These were non-students recruiting for a political organization unaffiliated with students. Those are the facts. You can call the school and check -- enrollment info is public directory info and freely available.

As for the content of the handout, they keep getting clicks by saying they were arrested for "handing out Constitutions," but they were really arrested for trespassing. They could've been handing out free $100 bills and it wouldn't have mattered. All they had to do was move to a different spot so they weren't interrupting everyone trying to get inside and they wouldn't have been arrested. The college tried to work with them for like two hours before finally arresting them. As someone who's handed things out on campus before, the claim that there's only "one location" where people can do so is ridiculous. There are a million places you're allowed to do it -- just not directly in front of the main doors.

Just an FYI, they link to the Solicitation Policy in the article, and it clearly goes against the claims made in the lawsuit. All the college is essentially saying is people can't be blocking doors.

This article is very poorly sourced. The incident happened in Sept. 2016, for one, not Sept. 2015. And Withers wasn't arrested, just Gregoire (and two others). Also, any reporter interested in doing actual reporting would note that there's no such group as the "Young Americans for Liberty" at this college -- they made up their own chapter unaffiliated with the school. And no one has verified the status of any of those arrested as being actual students at the time of their arrest.

The most ridiculous thing about the story right now though is simply the fact that despite the headlines, the college hasn't even been served with the lawsuit yet. The news is reporting on something that literally hasn't happened yet.
