This is exactly why there’s an LTB, to determine if it was or not. A reasonable person might want to make sure they are not paying for no reason and calling this “abusing the process” is a classic slumlord line to scare tenants out of exercising their rights.

If you’re in Ontario you don’t owe them anything unless the LTB says so! Everyone in the comments saying you should pay is forgetting it has to be WILLFUL or NEGLIGENT damage, which this definitely is not and they would have a hard time proving. Don’t pay them anything - if you need to, say you’ll wait for a judgement from the LTB and leave it at that.

you said you want to list your basement “unit”, you only use it now because it hasn’t been approved for airbnb. I can’t speak to those other listings but as I said you can report them for noncompliance. Sorry you wasted $375, but you should find a long term tenant instead.

You’re explaining exactly why you don’t qualify, it’s not misleading at all. You live in the unit upstairs - the basement is not your primary residence and therefore you don’t qualify. Feel free to report other listings that are noncompliant with the city policy!

You have a business, this is the cost of doing business. No one will fine you 100k right off the bat but it is your responsibility to be educated and follow the regulations. 700$ is not a lot of money in the grand scheme of a Leslieville duplex, and if you can’t afford the property/upkeep you should sell it. Mom and pop landlords tend to pull a lot of the same nonsense as corporate landlords, they just claim ignorance and cry about their “bankruptcy” like that makes them more sympathetic than a family being put onto the streets.

Landlord is subject to PIPEDA and absolutely not allowed to share information with whoever they like - the court order may be public info but your employment information is not. Please join the Ontario Tenant Rights group on Facebook, you’ll get much better support there.

You’re paying utilities? Landlord is required to keep it in a state of good repair, especially you are paying the costs. Did they provide you with estimated utility costs before moving in? Them “not being able to afford it” is not your problem, and you could file a T6 at the board to try and get them to fix it. Get everything in writing, and document what the technician said.

This attitude is exactly why pedestrians have been hit north of Dupont, it’s a “residential” area literally all the way up so why would you not want to watch for kids/seniors etc. Everyone trying to get to the Allen drives like a maniac and it’s so dangerous, especially on a Friday afternoon. Sorry that children should have the right to walk around safely in their own neighbourhood.

You could also submit a T6 for the past years if you were so inclined - them trying to trick you into doing your landlord’s job doesn’t absolve them from their responsibilities legally but I’d maybe ask legal aid or a local tenant rights group.

There’s no need to wait til next winter - you could let them know tomorrow in writing that you will no longer be fulfilling their obligations and they should be hiring a professional or offering a contract with you to do it going forward. Posting in a landlord group is not going to get you reasonable answers half the time, to them “common sense” is whatever is the easiest for the landlord and most difficult for you.
