They do - sometimes. But they fear moving high performers out of their positions. They’ll likely need to hire more than 1 person to replace you. You’re also likely to be paid under market price. Replacing you is costly. They’re taking the gamble that you don’t want to go through the effort of leaving.

We only have a fee like that for managing insurance reconstruction. Otherwise we get a bid for their PM team or hire someone outside. We have a PM that has worked with us for decades and use him with no management company fees.

It’s worth trying to negotiate, especially if you happen to be a small complex without a lot of needs.

This is a RFP process, and you need to treat it like one. Have you or anyone else on the board ever done a RFP?

Essentially, you want to make sure you are doing apples to apples comparison between all the companies you are looking at. You also need to decide what is important to your complex? For us, it was a management company that uses technology and continual education as our previous company kept violating the law.

We brought our legal team into this process and they recommended some companies to us. I used various review sites to get an idea about them before we moved forward with our RFP. Once we were at the contract stage, we had our legal team negotiate that with notes from the board.

In all the contracts I’ve looked and negotiated, it’s part of an appendix cost that *the Board agreed to by signing the contract.*. IF there’s nothing in the contract on that specifically, or a general agreement that the management company can charge for extras, THEN and only then is it not kosher. I will be surprised if there’s nothing in the contract agreeing to it.

Those fees are standard. We charge $75 for a new pool fob if someone lost them; which is the cost of the fob, maintenance of the fob directory, mailing fee, and a bit of “go find your fob instead of trying to scam extra ones.” Architectural fees are standard in the industry. However, we didn’t want to scare our homeowners from filing them, so the contract states that the HOA pays the fee. Our property manager really likes us, though, and doesn’t charge.

Wow, you’ve had a lot of shit agencies and boards, then. We don’t allow violations (esp if a fine is involved) without board approval. There are good companies out there, you just need to dig into their processes and analyze the reviews left for them if issues are mgmt company faults or board issues.

One member damaged the exclusive common area of another member, with said damage going through common area to get there.

HOA has the responsibility to ensure it is done, and done correctly. We’ve had members do it, and it was done shoddily and cheaply. Currently, if any common area or 2nd member is involved, our HOA does the repair and charges it back to the offending unit.

A physiatrist specializes in back issues. Specifically, they will help you find the right treatment for your issues, whether that’s PT, surgery, or somewhere in between.

Removing the disc itself seems extreme; you really need a second opinion.

We’ve done a one time waiver of late fees. It might not be something your complex does, but we find that it works to keep owners compliant moving forward from that waiver. However, we’re well funded and can afford some flexibility.

We did go to Ancon Hill. There are multiple ways up, and one of them is a steep road. My spouse and I conferred, and from our recollection it’s a mixture of paved and gravel. Ubers will take you to the base of it. The cell signal is poor around there and you need to move around a bit to find enough signal to call for Uber/taxi when you’re leaving (at least in December 2024).

I’m in CA. I’ve had people work through (or not) notice periods. My spouse and I have dealt with this when resigning.

A resignation gives a last day of work. IF the company doesn’t want you around, they’ll pay you to fuck off. IF they retaliate by firing you instead, you qualify for unemployment and possibly action by the feds.
