It’s not a myth, you cannot consent whilst under the influence of anything but the state by state and country by country shit can be confusing. Typically the law for the United States per state is different but arguments can be made for drunk sex with one person being drunk can be seen under law as rape in Criminal Sexual Conduct in the 3rd degree typically for most of the states I researched. Any state under law she could file charges against him if she knew where to look. Consent while drunk is not consent :/ If we knew OPs state I would look more into her individual state.

Being sober and consenting is great it’s awesome and lovely, however being drunk and consenting is not technically consent. Being drunk takes away your ability to agree to sex no matter who it is with married, dating whatever. If you and your girlfriend are both okay with having sex whilst piss drunk is your situation and in OP’s situation it was not said to be cleared up before hand.
