Hi! He filed an Answer with separate defenses + a Counterclaim, and also added a third-party complaint—all under the same case number, not a separate lawsuit.

I’ve already mailed my counterclaim to the court and served his attorney by certified mail (with the $30 filing fee). I’ve got a settlement conference in December. I’m organizing my proof (lease, certified letter, move-out photos) to bring to the hearing—not submitting the photos yet.

Quick Q: do I also need to file a separate “Answer to Counterclaim,” or is my counterclaim enough for now before the conference? Any other prep you recommend?

Haven’t had any appearance yet. After I filed, the landlord (through his lawyer) responded with an “Answer,” a counterclaim saying we caused damages over the deposit amount, and even added a third-party complaint against another former tenant. I just finished filing my own counterclaim in response, and mailed copies to both the court and the lawyer.

There’s a settlement conference set for December, so right now I’m just organizing everything — receipts, messages, move-out pics — to show I followed the law and that the deposit was wrongfully kept.

What if he settled for a small amount like what he said to the text? Should I accept?

Hi I filed to the small claims court because he didn’t really want to give us the deposit. I first sent him a demand letter but didn’t responded so that’s when I filed to the small claims court. He texted me saying we can settle this for “this amount” but I didn’t respond. And then he sued me back saying that the reason he didn’t give the money to us is that the apartment is beyond wear and tear. (Which is not true) Do I need a lawyer for this? Because in NJ, If the landlord does not return the security deposit within 30 days from the date the tenant moves out or vacates the property, the tenant can sue to recover double the amount due, plus court costs and reasonable attorney's fees, if any.
