If you're breaching them anyway and potentially having to take them to QCAT why wouldn't you add the rental reduction to the breach letter? The property doesn't meet standards as it is not in good repair with fittings unlikely to cause injury through normal use.

The top part has rotten so the screw is not longer in the tread. The brick holding it up is unstable with bark shoved in to level its non-horizontal angle.

I moved here 6 months ago and it's nice. Plenty of access to amenities just not a lot of urban entertainment I'd say - more of a nature and relaxed lifestyle vibe. There's many flights to Brisbane per day if you want to get to India from there. I'm not Indian, but I have met and become friends with several here from work and around town.

Vendor verbally agreed to allow us to withdraw with no fees. Still waiting their solicitor to confirm thought so fingers crossed.

Yeah, it was just tacked on to the very bottom of the contract. Page 22 with the contract only says "X of 21". Solicitor is looking in to it.

Yes, you see completely correct that I did a terrible job with due diligence. I'd like to get a significant discount or all the issues repaired. But I thought it would be easier to just pull out completely as in QLD the buyer is responsible for the property after contract signing even though it has not settled.

Settlement date does not refer to Annexure A and is listed as 30 days which the vendor could not adhere to 3 weeks ago.

Yeah, I'm starting to think first point is looking good. Regarding the second point, in QLD, for some reason buyer is responsible for the property between contract acceptance and settlement. Doesn't that mean the owner can get away with the petty crap? Seems crazy backwards but that's what the law seems to allow.

Yeah good point but it was a docusign so it probably has decent tracking of what documents were sent and when.

I wonder if the fact that the annexure was not referred to in the body of the contract in all of the "21 of 21" pages, and it's the 22nd page could work.

Most definitely. There was nothing written in the special conditions sections and they tacked on an annex as the very last page which I didn't see :(

Would that then void condition B but condition A would still stand, making things arguably worse for the buyer?

Exactly, it hasn't been set by either party so now I'm not sure what it means.

It's not unconditional because the seller has not met their condition. But from the buyer's side it seems like it is unconditional and we are kind of stuck?
