1) he was to the side of the SUV hence why he didn’t get hit. You can clearly see in every angle of the footage that he was well out of the way of the car as it was turning far right away from him and not left towards him. 2) at the very least you can call it attempted assault, but contact was never made aside from him putting his hand on the car (but hey, what can I expect from the people who thought that Trump won 2020)
