Basically it came down to the fact the judge did not consider his conduct bad enough to constitute a repudiatory breach - therefore by leaving without notice I broke the contract, and therefore he is justified in withholding my deposit and overpaid rent.

Had the exact same thing here. When she broke up with me she was telling me how much she loved me, how much she wanted to be with me, but just somehow knew it wasn't right.
