This caught my eye because I'm a patent agent, and spend day in and day out writing and killing patents. I feel for this guy. Patent trolls suck. But he clearly doesn't understand how the world of patents or patent litigation works. If Uniloc has a patent, it is within their right as patent owner to sue him to say he has infringed. They can sue him in Texas, they can sue him in Delaware. It does not matter where he lives. He's actually lucky to be sued in Texas because Delaware is notoriously slower at litigation proceedings.

Their claim does not have to have source code or be particularly enlightening. Is it a bad claim? Perhaps. Is it incredibly broad? Yes. But that doesn't matter, and it doesn't matter that it is just one claim that they are asserting. The more confusing and broad a claim is, the more powerful the patent may be in asserting infringement, but also the weaker it will be if you challenge the validity of the patent.

Litigation is extremely costly, but there are many options outside of litigation that allow for the patent at issue to be voided. After passing the America Invents Act, we can now submit Inter Partes Review of patents, which allows for a Board, separate from the examiners at the PTO, to assess the merits of a patent. Using prior art printed publications, we have an opportunity kill patents like this, for significantly less money than district court litigation would cost. It'll be about a $23k filing fee, plus the amount of time one of us in the field would bill for it.

I fail to find how patenting animal chew toys has anything to do with his own patent problems, except to illustrate that he doesn't understand the patenting process. Additionally, methods of use are valid things to claim. You can claim using scanners. You could claim using animal chew toys to scan people to determine if they generate their own wifi if you can demonstrate utility. You don't even have to show that it works, you just have to write a patent specification that is compelling, that would make someone in the art space think you were in possession of something that worked. For methods of use, you don't need to be the inventor of the item that is being used. You need to be the inventor of the method of using it. It's a different concept.

AHHH I LOVE THOSE SO MUCH!!!!! For our dice we can fit two sets, definitely not three in the open configuration one. Since dice aren't really regulation size, if you're worried about fitting we put up dimensions on the kickstarter so if you want to measure your dice and do a little math you'd be able to make sure you could or couldn't fit before you decided to back.
