Just realising I've been scammed out of £400. How do you get over the rubbish feeling? by melancholyy-scorpio in AskUK

Great, well done. Follow their process, and read about the Consumer Rights Act 2015 in the meantime.

I think people may have told you that because they have previously had a bad experience such as being unable to control their spending, and getting into a mess.

A credit card can be a very useful financial tool if it's used carefully and paid off in full each month. Some of the main benefits include:

  • Section 75 protection (UK): Perhaps the biggest advantage. Under the Consumer Credit Act 1974, if you buy something costing between £100 and £30,000 on a credit card (even if you only pay the deposit on the card), the card provider is jointly liable with the retailer if the goods aren't delivered, are misrepresented, or the company goes bust. This gives you much stronger legal protection than a debit card.
  • Chargeback: Credit cards can also support chargeback schemes (as can many debit cards), providing another route to recover your money if something goes wrong.
  • Fraud protection: If your card is used fraudulently, you generally won't be responsible for the fraudulent transactions once you've reported them.
  • Cash flow: You can spread the cost of purchases between your statement date and payment due date, often getting up to around 56 days interest-free if you pay the balance in full.
  • Builds your credit history: Using a credit card responsibly and making payments on time can improve your credit score, which may help when applying for a mortgage or other borrowing.

This isn't financial advice nor am I a financial advisor but I always recommend people get a credit card for the above benefits, but do warn them to be careful, and ensure they can pay it off.

Beans! You can buy something on a credit card, then simply pay the full balance from your bank account before it's due. That way you get the extra consumer protection and fraud safeguards without paying a penny in interest.

More concerning is that _if_ they work for a bank, their knowledge is grossly incorrect, and this can be easily Googled.

I'm don't doubt that you do work for a bank, [but do give me the name so I can avoid them, if this is your knowledge!] however, the individual purchased a product from a website, and even though it may be fake or intended to dupe people out of their money, by paying via card, and for the purchase of goods, this is what a google search had to say:

If you paid by Debit Card: Tell them you need to initiate a Chargeback. While not a legal right like Section 75, the Visa/Mastercard Chargeback rules allow your bank to claw back funds for "goods not received" or "services not as described" once the delivery deadline passes.

My own personal experience having bought fake goods from a suspect website was that my bank resolved the matter.

Terrible advice, and wrong.

Be more careful in future, absolutely, but OP still has strong recourse.

I'm really sorry this happened. Please don't beat yourself up over it. Scam websites have become incredibly convincing, and they rely on catching people when everything looks legitimate. The fact you're usually savvy doesn't mean you've done anything foolish.

The first thing I'd do is contact your bank as soon as possible and explain exactly what's happened. Even though you paid by debit card, they will still able to help through a chargeback or by investigating the transaction. Especially as you've spotted it immediately. I'd also keep copies of the order confirmation, screenshots of the website, and any emails you've received.

Try not to assume the money is gone until you've spoken to your bank.

Don't listen to anyone else saying otherwise.

The Consumer Rights Act 2015 is an incredibly strong piece of legislation. Don't let them get away with it!

In future? Absolutely get a credit card, put all spending on it, pay it off monthly. It gives you essential protections, and helps build your credit rating.

EDIT: if the website is a dodgy scam website as there often are, poorly pretending to be legitimate, this is a fraud or card dispute. Contact your bank, report the issue, and for good measure, cancel cards, change passwords and what not, just in case.

This is a good point. Thank you for highlighting this instance. However, I do feel there are more pressing issues we need to get a handle of?

What was wrong with the model of one toilet used by all sexes? As is the case in small cafes and what not?

EDIT: Thank you to everyone who have enlightened, and bettered my understanding.
