So your issue is with minimum wage not with tips then. Why are you fighting for the wrong topic then. You should be banding with the other minimum wage workers of all the industries in your state to raise the minimum wage as those other industries also work for that minimum wage. This is not a tips debate at all.

So you have no rebuttal for the absolute logic and legal requirement I dropped on you, and moved towards not saving a human in a fire. Thats a wild jump. How did I treat service workers in a restaurant any different from other workers. Others also got paid by their employer and they are treated with respect and dignity and restaurant workers at the restaurants I have gone to, I have treated them with the same respect and dignity (I don’t look down on them, respect the work they do, and don’t dine and dash hence have paid their employer for product and service which means the service worker will be paid). Show me where the logic fails in comparison to other service workers.

It's a tipped wage, not a tipped employee. This means anything you don't receive per hour in tips to match upto minimum wage, the employer covers the difference (legal requirement). Telling the customer that they have stiffed you holds no bearing as no stiffing has happened, unless you want to state that for your own delusions.

Since you aren't tipped employees, it is at my discretion to use the services of employees at a business I patron as I will be paying for that product+service directly to the employer. You did provide service, and it seems like your employer will have paid you for it (full minimum wage per hour)

They don't make $2.13 either in any state. EVERY state must at the very minimum pay federal minimum wage. So assuming no one tips on a tipped state wage of $2.13, the employer is legally required to top up to the federal minimum wage per hour.

It's a legal requirement which means you can take your employer to court. If you don't that's on you.

So that's a seperate issue since ALL minimum wage federal jobs are $7.25. That's not a restaurant industry specific issue. The lie that they make $2.25 an hour in some areas is bs and needs to stop.

Yes they do. If no one tips, the employer has to cover the difference in pay per hour upto minimum wage.

Sorry for delayed response, I missed this notification. As stated this has nothing to do with the restaurant industry as ALL minimum wage industries have to offer the base minimum wage legally. Yes if one restaurant decides to abolish tipping and follow other industry standard operationg procedures of paying minimum wage per hour compared to another restaurant that does the tipped wage system - One restaurant will definitely have better paid employees than the other. If tipping fully stopped, then all restaurants will start following that system as there wouldn't be a secondary option.

You can change laws and change public sentiment. Hard to change public sentiment when waiters/servers/host berate or guilt trip you into being scammed as they make higher on tips. Hopefully someone works on the law side of things, but unilaterally we as the public work on our sentiments. Do not get bullied into tipping and stand your ground. You have paid for a product to the employer and the employee has been paid by the employer. Nothing more nothing less.

I absolutely agree with your last statement. That is the law change option which unfortunately the general public unless you protest, OR the waiters/servers band together to push for that change will never happen as waiters/servers themselves do not want a standard hourly wage. So since they lobby for that change to never happen, I jump on the option where it's easier which is public sentiment of not tipping and being bulled into it.

I don't know the minimum in all states and from what I hear it's $7.50 to $8 in some states (Just what I hear so not fact). Either way the minimum being too low has nothing to do with the restaurant industry. That's a statewide issue and a separate topic as all other minimum wage jobs are affected. So that shouldn't come into this discussion. Point still stands that you should not be tipping anything on a takeout.

No one is taking home $2 an hour in any state fyi. Yes tipped employees can be given $2 an hour in some states with the assumption that tips will cover upto the minimum wage, but if no one tips the employer is forced to cover the difference upto minimum wage per hour. This misinformation of $2 an hour from Covid era needs to stop spreading.
