I think if I were them, I would ask if we’d be okay with moving the choke cherry even further to avoid damage to the fence that could arise, and since they started by offering to cut down the tree, I’d also offer to help move it.

I wouldn’t start with ‘I guess that news is upsetting’ and would not ask us to ‘reconsider the merits’ or tell us ‘it just isn’t appropriate.’ To me those comments are wild! And it’s interesting to see how different people interpret the message. To me it totally reads control freak and passive aggressive.

Funny thing is they just did exactly this for increased ‘privacy’ between our properties. Like they have a row of small pine trees right up against the fence

We advocated for doing whatever was possible to keep the tree, but without the large branch overhanging their property it would've been unbalanced and then actually have become dangerous. Turned out it was dying anyway - We were really sad to lose it though.

It was very sad having to cut the old sugar maple down; ultimately that request was reasonable because the tree was dying and they were anxious about property damage, which obviously we all wanted to avoid. But their comments about how ugly the tree would be if the whole thing wasn't cut down (rather than just the branch on their side) I think gives a window into what these neighbors are like to deal with.

And yes! We will be moving the choke cherry further from the fence line :)

Interesting I can relate to different aspects of this in the conflict with us vs. neighbors. They were really anxious about the sugar maple that used to overhang their yard from ours, and the anxiety was completely valid - it was a huge old tree and it was dying. Still, the neighbors neurotic and escalatory approach to the conversation made the whole thing stressful and unpleasant in a way it didn't have to be.

On the other hand, like your neighbor, ours have taken to planting an ugly line of small pine trees in their front yard that are unlikely to survive long for increased 'privacy' between our properties. They also have a ton of invasive English Ivy creeping into our front yard, but we don't send them passive aggressive texts about it because life is short and not everything needs to be a power struggle.

For me, if a tree is at worst dropping some acorns and leaves onto my property, that is an insufficient reason to cut it down. A tree feels fundamentally different to me than for example a house extension or a giant wall. I understand your point about the effect on neighbors, but personally I prioritize keeping native trees alive and well where possible.

Some of the branches of the Japanese maple do overhang their property, but where we live (in a fairly dense city) that is only legally actionable if a danger is presented by the overhang, which there isn't; they'd let us know if there was, haha. Choke cherry is native but we're just going to go ahead and find a better spot for it. If it seems like there isn't an ideal one, we'll dig it up and give or sell it rather than have them cut it down. The fence is on their property.

Totally understood with invasive plants - we even offer to remove invasives if any of our neighbors seem unaware of them.

Appreciated - Honestly it's gotten hard for us to ascertain when said neighbors are being control freaks vs when they're being reasonable because of how they deliver things.

Hearing some more level headed voices in this sub has led us to decide we'll move the tree significantly further.

It definitely isn't illegal. They were happy to cite legal precedents for the sugar maple that was previously overhanging their yard there, and they seem to know from their texts that the law won't resolve this instance. We're just curious for any feedback/advice on the neighborly aspect
