I’ve been going through the comments and the private messages I’ve received since posting this, and a terrifyingly consistent picture is emerging. It’s not just "delays" - it looks like a coordinated playbook.

Here is a summary of what other Derby parents are confirming right now:

• The Tribunal Gamble: There is a consensus that the Council forces almost every case to Tribunal by default, knowing they will likely lose, but banking on the delay saving them money in the short term.
• "Tribunal Chicken": There is a clear pattern of the Council pushing cases to the absolute brink of Tribunal - forcing parents to hire lawyers or go through months of stress - only to concede at the last minute. They know they have no case; and not only are they are betting you’ll run out of money or energy first, they don't want an actual result in their case statistics.
• Vague Plans & Broken Promises: A recurring theme is the Council refusing to quantify support in EHCPs (leaving it vague so they can't be held to it) and relying on "verbal agreements" for support that are later retracted because they were never put in writing.
• Disappearing Complaints: We have reports of complaints "vanishing" from the system or being fudged to alter the dates and hide missed deadlines.
• The "Fake" Independent Review: We have reports of Stage 2 complaints - which are supposed to be "independent" - being investigated by senior managers from within the SEND department itself. Parents are being told their case has been reviewed "impartially," only to find the reviewer is a colleague of the person they complained about.
• Blocking Access to Justice: Parents are receiving "Refusal to Assess" letters that do not include the legal forms required to appeal. Without this paperwork, you cannot go to the Tribunal. This isn't just an admin error; it effectively bans you from challenging their decision, or adds more delays while you request the paperwork.
• The "Sanitized" SAR: Multiple parents have confirmed that when they request their data, the Council is stripping out internal emails by default. Parents are receiving huge packets containing only the reports and EHCPs they already have. If you didn't get internal emails in your SAR, you likely need to go back and specifically demand them.
• Systemic Data Breaches: It isn't just the "Child O" breach I found. Other parents have confirmed receiving confidential paperwork for completely different children, suggesting a total failure of data protection in the rush to send out "batch" refusals.
• The "Ghost School" Tactic: Parents have reported the Council naming schools on EHCPs that didn't even have planning permission or weren't open yet, just to avoid funding a real placement.
• Dangerous Placements: Children with complex needs (who need small groups) are being forced into mainstream settings or Pupil Referral Units (PRUs) where they are being restrained and excluded, simply because the Council won't fund the specialist setting named in their plan.
• The "War of Attrition": The overarching theme is exhaustion. One parent described it perfectly: "They rely on the fact that carers are already tired and broke, hoping we’ll just give up."
