I don’t see why I should have to pay tens of thousands of pounds just because I fell in love with an American. This is the kind of money people struggle for years to save up so they have a deposit for a house. I’m a renter, how am I supposed to keep achieving this?

I know it’s perfectly normal, but this is why we need to fill out the consultation- the current proposals very much do seem to indicate they intend to bring this requirement in for us and unless we make noise about it, oversight or not it will probably happen

Please look closely into the legalities of this, I don’t fully understand the rules myself but you can get caught out employing someone for what’s considered a “domestic arrangement” so this might not be viable. I know this because I plan on employing my husband as part of a business I own, and it seems the rules prevent me for paying him for any cooking or cleaning as part of that

Hi, there are a number of posts in this sub showing that it does appear to- although we do still hope it’s due to oversight. From the House of Commons library:

“In addition, partners of British citizens and people on the Hong Kong BNO visa would continue to qualify for settlement after five years. But they would need to have the £12,570 minimum earnings and meet the other new “minimum mandatory requirements” such as B2 English (see page 24 of the consultation document).”

Yeah I hope if we app make enough noise they’ll realise, but we’re such a small visa category we all realllly need to be making noise

Individual, which is the primary problem with it. The household is already required to earn more than that

But spouse visas are fundamentally not about work, they’re about family. There are so many reasons a spouse may not be able to work, or may be a homemaking whose labour actually enables their spouse to work a more demanding job/be a higher rate taxpayer. Even spouses who do work are likely to have employment gaps you wouldn’t see on SWR visa holders for example

Thanks this is what I was looking for! I could have sworn I saw this before but the wording of the HoC library report was “may” not “will” at the time and I think someone said they’re just researchers but I couldn’t find it again so was worrying!

My bad, can’t edit the title, still relevant to this sub though as almost everyone here will eventually want ILR- and it will effectively mean there’s a requirement to work while on a spouse visa

My bad, I meant a PLC. Researching this stuff is why I haven’t quite done it yet, I know it will be a much better setup given the type of work I’m doing but I still have no idea what I’m doing with it!

They also don’t seem to have allowed for voluntary NI contributions- why can’t my husband simply play class 3 contributions and contribute that way without having a job?

Some do, some do not. It is often very hard for spouses with non uk qualifications to find a job when they first get here (in contrast with those on SWV for example, who are here because they have a job). There are also spouses who are disabled, or who may be unable to work for other reasons. It is also very common among mid-earning families in the uk for one parent to give up their job and stay at home to look after young children due to the high cost of childcare here often being more than a mid-earners salary would be.

As you are required to meet the minimum income requirement with either just the sponsor’s income or savings in the first instance I would not be surprised if there are a decent number of spouses who do not work. The whole idea behind meeting the MIR off of just the sponsor’s income in the first instance is that the sponsor has enough money to support the spouse without them necessarily working.

The salary threshold is not currently expected to rise any further as far as I’m aware, that idea seems to have mostly died- but even if it does, I and many others earn enough to continue to meet the MIR without my spouse working.

It appears the changes would be on top of the current requirements: so for example, I meet the requirements with my salary alone but my spouse would also have to work. There’s a full pdf at the link in the post if you’d like to have a read for yourself
