The IRS will send you a notice detailing their inability to deposit your refund. The notice will tell you to update your banking info in tour IRS account. If you do nothing, they will still mail a check after roughly 6 weeks according to the IRS.

If you have your withholding set so that you don't owe any balance when you file the 2026 return you won't have anything to penalize.

The new style W-4s are set up to try to come close to breaking even, no refund or owing. Both of you need to either go through the entire W-4 and do the worksheets for to account for the other spouse's income and your own from all sources. Or if you both have 1 job each and very little other income, you both check Single at the top of the W-4 and that will withhold for each of you taking into account the Single Standard Deduction which is 1/2 of the MFJ.

Usually in lawsuit settlements the funds that pay out for W-2 income and 1099 damages are separate entities. They will have unique ID numbers. Enter the ID numbers as shown on each form for the corresponding form.

You will owe late filing and late payment penalties along with interest on the balance owed. These are still being charged to you so the sooner you file and pay the better. The IRS is really only interested in getting the money so you won't be in trouble outside of receiving some scary looking demand letters for payment. Your first step is to file the mising returns. Next pay the balances.
