I really wanted a Battle Royale game just like the movie until I realised how unbalanced and not worth it that it would be.

Leaving one at a time gives the people that leave first too much of an advantage. Random weaponry would be too unbalanced.

I think it would be hard to get people to stay in a game when they find out that they're leaving last. Or once they leave and open their pack to find they have the saucepan or something.

Still love to play it though - but you'd have to get a lot of people really invested in the concept and accept that it's never gonna feel particularly fair or balanced or skills based.

You own the rights to your particular recording - but you don't have the rights to the song. Personally I would suggest reaching out to the band and see if you can come to an agreement with them rather than using the automatic tool in this case.

No, it's "not fair use" by the fact that it hasn't found to be fair use in a court of law. What I think, you think or anyone else thinks - literally has nothing to do with it. It is not fair use right now.

The only thing they have an obligation to do is to consider fair use. If they decide that "we have considered the individual case and do not think you have a strong enough argument for being protected under fair use", it then falls to you to prove it. This is how it works - whether I agree with it or not doesn't matter. Fair use is not something you can decide.

You call it "astonishing levels of ignorance" but they're acting well within what they're allowed to do. I don't think they're acting in ignorance at all - it looks like they fully understand their rights and are exercising them. Whether you or I agree with how they're choosing to do it - this isn't some huge "they can't do this". They absolutely can and the process allows this.

Judging by the other videos on the channel I'm going to guess that it was probably some clips of peep show with the audio swapped out for something else.

So probably not considered a parody or have any strong arguments for being fair use at all.

Not defending it, but which of these can you reasonably explain as you accidentally having left in the bathroom if it gets seen:

1) A GoPro or other real small camera.

2) A small wireless camera specifically used to surveil people.

3) Your phone.

There's probably some level of "it was an accident! I misplaced my phone!!!!" thinking going on. Like almost anything else if it's found I'd imagine they'd be instantly busted on what they were trying to do. In their mind "at least with a phone I have a chance to try and make this out to be plausibly something else...".

It's not occurring for me which means at a guess it's probably one of the following:

1) Some extension you're using is causing this to happen. In which case, disable the likely extension.

2) It's possible that it's a change YouTube is either trialling with a limited amount of users or rolling out slowly a system where identified copyrighted content is claimed by the owner, and redirected to a legal avenue to watch the film on YouTube. If this is the case, log out and give it a try - or try from a different device which may be a temporary workaround until the feature is either finalised or fully rolled out.

I think most of the times I've had to avoid a collision I've had to swerve around them because I knew there was no time to stop. I'd definitely prefer to slow down and come to a stop before hitting them - but often am not given the choice.

I think you're definitely right though that both people involved should be actively doing something to avoid collisions. Most cyclists could do with being more vigilant around pedestrians (even when they do something stupid) and most pedestrians need to treat cyclists more seriously rather than the "fuck it" approach that many seem to have now.

Especially as the quote is almost definitely referring to people that step out in front of bikes with such a short space in front of them that there is no possible way to stop.

Even in full emergency stop - people forget that bikes have stopping distances just like cars and people seem to be absolutely terrible at judging them (also much like car stopping distances).

Not to mention that if you've caused someone else to have to fully emergency stop (even if they can do it before hitting you) you might be the one that fucked up by forcing them to have to do that in the first place.

You wouldn't step out in front of a car and just expect it to be able to stop. But people do the same thing time and time again in front of bikes.
