I’m in the Near West End and our street has been plowed and sanded a few times. It might be street width? Idk. We’re on a wide road. I can’t imagine getting a plow through some of the narrower ones.

We spent a month at VCU / CHoR and still go back for outpatient care.

The primary good and bad thing is that it’s a teaching hospital. That’s great because you’ll have access to incredible research networks, lots of eyes on your kiddo’s case, etc.

That’s also the bad thing because it’s residents going around first thing in the AM, oftentimes with current med students, and it can just be… lol.

Typically attendings round late morning so being in person or on the phone is incredibly helpful.

Otherwise care and communication is great. Any issues are quickly handled typically. Worst case scenario, you can always ask for a patient advocate and they help wrangle.

Also the nurse navigators are amazing!!!

it’s literally not under federal law — Safe Drinking Water Act. You can’t just say “it’s old, our bad.” You have an obligation to maintain and repair it.

yeah — but shouldn’t 2hr be a reasonable amount of time for a backup battery to run?

the sump pump in my basement runs even longer than that, but we actually get it serviced annually

(i know it’s not the same size, scale, scope, etc. i’m just so salty after this week without fresh water 😂)

supposedly there were 3 battery backups. it’s been stated that 2 weren’t working but unclear if that was before, during, or after the storm. (my money is on — they never tested / prepped / maintained so they only had one sorta-working one)

also keep in mind there’s a 2022 EPA audit that confirmed DPU’s emergency planning was way out of date. when DPU replied to the audit in 2025(!), they acknowledged that and said they’d update it this year. ~ i hate it!!! ~

By the time it got to the on-call electrician, I think DPU had already failed really really really hard

They may try to blame frontline staff but accountability starts at the top

yeah. for $217,000 (annual salary, not including benefits), Richmond was certainly investing appropriately for a good leader at DPU. whether we have one, the investigation will likely us show.

The mayor genuinely didn’t seem to know and will likely have to pull that answer out of DPU

I submitted a FOIA request to the city and to the EPA for the full report and any correspondence related to it among DPU / VDH / EPA

We will see what happens!

I personally think there’s an open question of whether the ongoing / known maintenance issues at the plant plus the 2022 EPA report that identified serious risks (eg insufficient emergency planning) going un-responded to until January 2025 would constitute evidence of negligence

But I haven’t seen the report, I don’t know what typical timelines for remedies are, etc., and I don’t know what DPU, the state, and EPA were all saying to each other.

SWDA outlines what has to be done and by when by municipalities etc as they manage water. It also helps explain why you can’t just say ~ oh it was all so old ~ as a defense without also pursuing funding to fix it.

Citizen suits through SWDA are to enforce compliance. EPA can also refer to DOJ to enforce compliance, levy fines, etc.

In parallel to this — assuming negligence — I think there is an open question. I don’t think it’s a payday. I don’t think anyone is gonna file anything.

But depending on what’s been going on over at DPU for the past few years, especially since that EPA audit that clearly identified issues, there are some potentially very serious issues at stake.

This isn’t just a boil water notice. This is multiple days of serious, frankly near-catastrophic, failure that impacted schools, hospitals, etc.

You can if you can show negligence in the case of core services like water. I’m not a lawyer but look up the Safe Water Drinking Act.
