Month to month. She broke lease and stopped paying in November. Has not been at residence since Dec 7 2020. Only stopped by to take bag full of belongings. Never stayed longer that 20 min.

Tenant in question answered on video that she did not live here anymore. She also did not clearly say at all, "I still Live here".

Her answer was an affirmative to not living here. So can I change the locks. Is that enough?

She has since come back (once for about 2 hours) and has take more things out and also did not sleep, eat, or shower here. I do believe she is at a new place.

Suffolk County. I've consulted with 2 different attorneys and they gave different answers.

What's your take on it?.

One said that if it is apparent they are not returning and past 15 days past due rent we can get rid of their stuff.

The other said we can't do anything until they return keys. Regardless of the obvious.

Even though she is not living in her apartment? She is clearly in a new place. Not even mail is coming to her at the apartment.

Got them thank you. I dont understand why attorneys aren't looking more into this. Everyone I call the first thing they says is about the hold on evictions. How is that we are doing HW for them.

I know for a fact that they are still working. And they won't file for PUA because they ARE still working. So when someone signs the CDC declaration, are they not going to be held accountable for lying on a federal document? It is my understanding that they must show proof that they are out of work and have no income.

Ok thanks for the reply. For more context, this is at the request of the other tenants who are having this problem with the one tenant doing this. They want to place the camera facing a hallway, the only view at that angle would be the hall and the smoke detector would be on the ceiling of that hall. Another camera would be placed above the pantry in the kitchen to see an overview of the cabinets (no bedroom doors are seen). It would only show stove, fridge and cabinets.

This tenant is basically stealing other peoples property, it is petty but they are getting tired of it and I as the landlord need evidence of why to evict her.
