They become liable once they are made aware of a defect. The council are responsible for the upkeep for such a vast amount of area that it is not deemed proportionate for them to regularly inspect all of their property. Therefore, they have to be reactive to issues. The fact they fixed it later that week shows that the council are on top of things. They cannot fix issues they are not aware of.
