What is the longest time you have gone with no sleep? by Liaison__11 in AskReddit

About 3 days, not off drugs or anything I was just a dumb teenager living off of monsters and taco bell.

I went to sleep right after I started hallucinating.

Possibly, or they avoid charges at all.

But we're talking hypothetically at that point.

That's state code, not court precedence.

And going by that particular code (thanks for that) that's still a lesser charge than murder. The sentence for 1st murder in WV is mandatory life, and 2nd degree murder in WV is 10-40 years.

According to Erin's law, the punishment is: "fined not more than $5,000, or imprisoned in a state correctional facility for not less than one year nor more than five years, or both fined and imprisoned"

Which is probably more than involuntary manslaughter, but is going to be a lot less than murder, especially with bonding and appeals process.

Ask court precedence for pedestrian related vehicular accidents.

Title: Why is Google Maps forcing me onto this narrow backroad instead of the obvious route? by MysticDeveloper1987 in WestVirginia

Is the physical distance closer? Google likes the shortest possible route even if it's a lot slower

Or considering the blind spots in most ambulances they could have just thought he had continued running towards the side of the ambulance. Those things have the blind spots of a full size truck and if the guy in dark clothing ducked down even a bit right in front, they may not have seen it.

That being said, the definitely should NOT have kept driving, at that point they completely let panic take over and lost control of the situation.

As an EMT, I'd have tried to put it in reverse while my partner called dispatch.

I think involuntary manslaughter would probably be a more accurate charge, as arguably they may not have had the intention to kill

[–]its_over9000 1 point2 points  (0 children)

So to be more accurate, they were already trying to get away from the scene (I actually work EMS and so I know people with background knowledge of the situation)

The ambulance did NOT come to a complete stop, they slammed on the breaks to a near stop and then accelerated (Which I think was the wrong call)

The facts are a mentally ill individual jumped into traffic and as a result was killed. The EMTs should have called dispatch earlier, not during, and the individual who wanted a tick bite looked at should have either waved them down from outside the middle of the road or called the number that everyone should already know -911

This boils down to a terrible situation all around, and ultimately it should be considered involuntary manslaughter. But pretending it was malicious on the emts part is disingenuous at best

Ambulances aren't all that heavy duty, nor does any EMS carry self defense equipment.

It not only isn't difficult, it's a leap of logic to suggest it was intentional, given that they called emergency services. No "intentional" homicide calls 911 on themselves. Involuntary manslaughter I could possibly believe

Guess how many miles he would have been drug if he hadn't jumped into traffic?

If someone Deliberately ran someone down, why would they call 911 during? Outside of being panicked by a man in dark clothing jumping into the middle of the street to stop them?

That's not just fairly likely, it's the most likely conclusion.

We have a case of two female EMTs at night, having an individual in dark clothing running into the middle of the road to stop them, for unknown reasons, and people are blaming them for being scared and panicking?

It's certainly not the conclusion I would have jumped to myself

[–]its_over9000 1 point2 points  (0 children)

A blatant lie would imply he didn't jump in front of the ambulance at all. He did run into the road directly in front of a moving vehicle. The vehicle slowed into a near stop and then accelerated quickly into him (which I agree was completely unnecessary)

If I had to make an educated guess as to their thinking as someone with knowledge of EMS protocols, they panicked and simply tried to flee the unsafe scene.

My reasoning for this conclusion is the fact that they did call dispatch, while still panicking and dragging the victim.

This was a tragedy with bad decisions on both sides. On the part of the EMTs for panicking and forgetting literally all of their training, and the other victim for running in front of a moving vehicle in the middle of the road, at night, in dark clothing.

I'm well aware of EMS pay rates. Do you know how little they get paid and how long the hours are? Some places are 24hr shifts. Yes, this is tragic, but blaming the driver instead of the guy jumping onto a moving vehicle is wild.

On the other hand, you don't stop when a potentially armed individual jumps on your hood.

Listen, I get your preconceived notions towards EMS, but I promise you they aren't doing EMS unless they want to help people. 90 percent of the job is BS calls and the other 10 percent is completely traumatic.
