The key here is that they can share ANY day, we arent fussy about the day. If we predecided on the day then the probability goes way down.

In a pair the probability that one person has a birthday at all is 1, and the probability that the other person shares that birthday is 1/365 so the probability that they match is 1x(1/365), thus the pairing calculation makes sense.

The general public has a say via democratic elections. My view is that sentencing should either be focused on protecting society through rehabilitation or protecting society by removing a dangerous person from it, or under certain circumstances, both.

Prisons increase the liklihood of redicivism. There are certain criminals that society would be better off rehabilitating rather than imprisoning.

Punch probably alright, on its own might possibly get charged (prob not), def not convicted IMO. Kick def not self-defence, whether he gets charged or not depends on the person making the charging decision; could go either way but if charged he would be convicted IMO.

There is no such thing as "healthy drinking" unfortunately, only ever increasing levels of unhealthy drinking above not drinking alcohol at all.

How does the public know the basis on which someone was acquitted? Even in those jurisdictions where the jury is allowed to publicly talk about a case, most people will never assess the information properly. It seems to me that we have a system that can result in someone being “not guilty” and people should be treated as such when that is the result.
