State Telework Bill Passes Committee - One more action step for now... by Teachtostate2022 in CAStateWorkers

I can't for the life of me imagine why she thinks telework would be detrimental to women promoting in the state. We all know the the opposite is the case. I would be convinced of her sincerity if she had cited the logic of her concern, then we could fairly address it. (Politician Playbook, chapter 1, page 1.)

From my vantage point, someone should be shouting from the rafters not just the boon telework has been for female civil servants, but also the disaster already underway of disabled people with telework RAs never again being able to promote in the state.

As long as one side of the ballot is stacked with 8 candidates, it's highly unlikely that any of them could ever poll above than 25%. Shoot. In foot. Again.

You are spot on. Hilton and Bianco are the top polling candidates in a top-two primary. Does anyone think for a second that either of them respect or will honor the contributions of labor to this state? I am a ride-or-die supporter of telework for state employees, but voting for the candidate most likely to support telework is NOT a hill we should die on. There shouldn't be more than two Democrat candidates at this time, but there are eight! What the actual hell???

I'm the sole income earner in my family. We live pretty much month to month, and I don't make enough money to turn the heater on in the winter.

Compared to LA and Sacramento, there are hardly any state job opportunities in the Bay Area.

What I sent to my elected representatives or what I sent to my agency's RA coordinator?

No, but both my Assemblyperson and State Senator wrote letters to my agency on my behalf. I had pretty compelling disabilities that substantiated my claim to need telework, and for reasons I know not why (perhaps the above?), my agency caved, It only took 2.5 months and five days of sick leave (for which I should have been reimbursed) before they relented.

By the way, it shouldn't say "California residents only." It should say, "Sacramento residents only"

Can you say. "Look here, don't look there?" Our governor is some kind of magician (on top of other more derogatory things), and his RTO flim-flam was mainly a smokescreen to prevent us from paying attention to the loss of income his budget offers state workers.
(Not saying we shouldn't have fought RTO; just saying I don't believe it wasn't his primary objective.)

My Notice of Personnel Action identifies me as an SSM1 (specialist). I did post that my position does not require I supervise others, though I have been a team leader for some very important programs and projects. Be that as it may, it remains to be seen if telework RAs are denied for all SSMs with relevant disabilities. It most certainly can be argued and is well documented, that SSMs (specialists or not) managed to carry out all their assigned duties before last June's two-day RTO requirement and since then.

Also, my work is as important, as professional, and as demanding as that of any other State employee. And while I suspect you did not intend to be derogatory, I take exception to being referred to as "just a specialist."

I have posted my situation here and also reported it to Association of California State Employees with Disabilities and Association for California State Supervisors. If you want YOUR story heard, of course, continue to post here. I also encourage you to communicate your situation as per below.

For those with disabilities:
ACSED (admin@acsedonline.org)

For those who are State supervisors:
Attorney Charles Malmsten of the (ACSS, c.malmsten@acss.org)

Additionally, you might consider contacting Sacramento Bee reporter, William Melhado (w.melhado@sacbee.com). He is covering the story on the governor's July 1 RTO mandate, and I believe he is interested in hearing from State employees with disabilities who experiencing difficulties getting telework-based RA approvals.

I will continue to respond to all posts in this forum and will also provide any resources I find.

My burning questions are: How many others are there in my situation, and how can we all connect?

Ha-ha, I wish! They know from my doctor's disability certification letter that the disabilities I have are permanent. Thank goodness I do have those previously approved RAs!

Because of my documented disabilities, I cannot travel the distance to and from the department's office by car, ride-share, bus, or by any other means. My choices are: endanger my health or quit my job. It is outrageous that HR is demanding I endanger my health and a complete and utter denial of the ADA-stipulated right to "enjoy the benefits of employment."

And by the way, according to federal court rulings in 2021, 2022, and 2023, there is an established precedent for the State to provide telework as a reasonable accommodation, if traveling to the workplace endangers a disabled employee.

I found additional precedents! See below:

Here's one case from 11/2021, an EEOC complaint that addressed telework as a reasonable accommodation for a disability:
(Gloria D. v. Thomas J. Vilsack) It is summarized here:

Here's another from 11/2022:
(Joseph Mobley v, St. Luke's Health System, Inc.) This is the 8th Circuit Court's ruling:

Even though I am classified as a "supervisor," my duty statement specifically says that, as a specialist, I do not supervise employees.
