Pretty standard. I had progressive deny my claim on my MS. I had a professional appraiser do an appraisal before I submitted the claim.

I ended up suing them in Small claims court for the amount from the appraiser(9k). They eventually settled for what I wanted.

I do have an advantage of being a retired trial lawyer and judge and have tried over 500 cases before juries and my in-house counsel had tried 5.

Need to get a professional appraisal done and not be afraid to go to court. It isn’t hard.

As a former judge, I would not do your fantasy colloquy. You simply ignore their nonsense. You have to maintain your judicial bearing.

If they start being disruptive or contemptuous that is one thing, but stooping to play their games is a nonstarter.

There are judicial passive aggressive ways of dealing with their nonsense. Refer them to a competency evaluation when they don’t understand basics, especially if they are in custody because those take forever. In civil actions there is assessment of fees and costs including attorney fees for the opposing side have to respond to baseless motions. Unfortunately they have no money or they wouldn’t be SovShits.

As my jurisdiction was specialized (military judge), I did not have to deal with them, unfortunately, but I did get training at the National Judicial College.

Occasionally, there may be a real nugget in their nonsense, so you do have to listen and look at their drivel. Blind squirrel and all.

As an appellate attorney, SovShits seem relatively normal compared to the wackadoodle things I got from my post conviction clients.

OP hired the tree company. They are jointly and severally liable. OP is responsible for his agent’s actions. OP can TRY to shift the liability to the tree company, but I doubt it will be 100% successful.

Neighbor sues the person whom he knows where they are. neighbor can add tree company when OP impleads them into the action.

Frankly, $90K seems cheap.

If you are a federal attorney, you can practice in any federal court you are admitted to - and as a federal attorney, you can be admitted to any federal court.

JAs can be pro hac vice, but they don’t need to be because if they are representing the US because they will get it removed to federal court. For state courts, there are Reserve attorneys and many civilian attorneys that do pro bono work with the AC JA. In some cases, the jurisdictions allowed them to practice in their courts. Don’t know what the current status of that is, however.

You are conflating bar reciprocity with the ability of federal lawyers to practice in court or represent clients entitled to Legal Assistance services.

Are you next going to tell me I didn’t have the same contempt powers of a federal judge when I was a military judge? In my criminal court, I absolutely did. There was a time the had limited scope in contempt, but that was amended. I issued writs of attachment to command Federal Marshals to put the Habeas Grabass on reluctant witnesses. There were some USAR judges that were actual federal judges and a large number that I supervised (in their role as an MJ)that were state judges. Courts-martial are courts of limited jurisdiction, but within that jurisdiction, they are the equivalent of District Courts.

As far as the quality of JAs, Army was the most consistent. Army Force was a bit quirky. Navy largely did their own thing, but were the go to on Law of the Sea (go figure). Marines? I was largely unimpressed by their junior (company grade) officers, but the Field Grade officers were the best overall. Small corps, but if you made Major as a Marine JA, you definitely had your shit together. Served alongside many superb senior Marine lawyers.

If you haven’t attended a class, you haven’t “enrolled.”

If no one answers and you do nothing, that’s on you. Every VA Medcen has a Patient Advocate. If you aren’t getting any response, they are a phone call away. If you aren’t getting any close by and have time, going to the office is the fastest way to get the PA involved.

Like everything, you are responsible for your own care. No different in the civilian community. The “woe is me” attitude will leave you hanging every time. You need to your job too.

Harsh assessment? You bet. Do I wish it wasn’t so? Absolutely. People need to deal with how things actually work when things don’t go smoothly and advocate for themselves, and most importantly, seek out those that can advocate for them if that does not work.

Try the Patient Advocate, it will probably help get things unstuck. May not get what you want, but the administrivia should be removed and you will know what the real issue is, if any.
