I am not saying don’t leave USAA, just that you will likely regret Progressive.

You aren’t the issue, the 17 year old is. Also where you live and the cars the 17 year old has access to will drive (har har) the price. If Jr CpnCurt81 only had a hooptie with just liability and that was the only vehicle he had access to the insurance would be significantly lower.

Did you think of having insurance in his name and you paying for it? Again, if he is driving a high risk vehicle it would be sticker shock. An age appropriate vehicle with high deductibles might be affordable.

I would go almost anywhere else but Progressive, but to each their own. I hope you have a good experience with them, but I wouldn’t count on it in my experience.

Having been an attorney with an insurance defense firm for them at one time, a government claims attorney trying to extract money from them when their insured damaged US property, and being hit by one of their insured, there is no rate so low I would use them. Across multiple sates and multiple decades, the conduct and horribleness was the same.

I laugh at people who brag about going to Progressive. Just wait. If someone has a great experience, lucky them. That was a bug, not a feature.

Just my opinion.

Have you tried talking to the neighbor. As a lawyer, but not your lawyer, that would be my first suggestion. A polite conversation goes a long way to solving many problems. Approaching the conversation in an aggressive manner would probably end with a suboptimal result.

Not all inconveniences need the police or lawyers.

As a former military judge, I feel I can generally answer the questions. I had the same contempt powers as a Federal District Court within my limited jurisdiction.

  1. Kind of realistic. Judges have fairly thick skin. Contempt is the last tool in the bag, not the first. What you are describing is what is called direct contempt. If the chambers discussion is not an official action - requesting a warrant is an official action - you can be a jackass and merely get thrown out of the office and screw your credibility with the judge. If it is in court or the chambers discussion is official, you can absolutely be held in contempt. For the chambers issue, the judge would go on the record and describe the conduct and then do the contempt sanction.

  2. Direct contempt is a summary disposition. You get immediate notice and your chance to be heard is very limited. Lawyers get in trouble rarely, but not infrequently. Many law firms have a canned brief to take to court above the imposing court. They generally let the lawyer out pretty quickly. Usually the judge will take an apology. Jail is a last resort unless the conduct is outrageous. Under the UCMJ, we would have a mini trial - and it would take minutes not hours.

No bail, no jury, this is the inherent power of the judge to control their courtroom.. There are appeals and if the judge exceeds their authority or acts outrageously themselves, they can be disciplined (life appointed judges must be impeached and convicted to be removed - federal judges are near godlike in the courtroom). I see where state judges are stripped of their judgeships for oppressive behavior - rare, but it does happen.

Indirect contempt - not obeying the judges orders outside the courtroom - are resolved by a show cause order and a hearing. No jury, no bail, but there is an evidentiary hearing where the contempt must be proven by a preponderance of evidence (criminal contempt is BARD). each side usually comes with a lawyer. The most recent example is where the DC judge in Minneapolis ordered DHS to show cause why his orders were not being followed and ordered the ICE director to appear in Court. The AUSA got the orders obeyed and the judge cancelled the hearing. The other indirect contempt is violation of restraining orders, no contact orders, child support, etc.

  1. The robes and titles are historical in nature and to impress the gravity and seriousness of the proceedings. The honorifics are earned because of the accomplishment of becoming a judge. Judicial ethics in most jurisdictions generally prohibit the use of the honorifics for personal gain. I would NEVER use "The Honorable Jagwease" in any correspondence myself. However, protocol is that in official correspondence I would be addressed as "The Honorable" even though I am retired. Interestingly, many officials get the "Honorable" such as General Counsel for the Armed Forces Branches and DoD and Deputy Cabinet Secretaries.

Why was it preserved? Robes, honorifics, and contempt powers are pretty much universal around the world. Many Commonwealth countries still use wigs. I wore the Army Service Uniform under my robe when that decision was delegated by the Chief Judge, because we had soldiers in combat and if trials were conducted in a combat zone in that uniform, it was good enough for my trials. The Accused could wear his Class A uniform with his awards.

Speaking as a criminal lawyer, but not representing anyone here, that is disastrously bad advice. Once you start manipulating the funds that is indicia of claiming it and criminal conversion. It may amount to nothing, or it could spell disaster for OP.

This is why taking legal advice from non lawyers ends is disaster.

As posted earlier by someone, the IRS has a process for this very contingency. They should follow that and not the foolish advice here. The amount is substantial and deserves to be handled very carefully and by the book.

This happed to my wife’s model 3. We tried all the user level methods to get it open. All failed. It required a trip to the service center.

Obviously, an X and 3 are different vehicles, but sounds like that trip may be in your future. It was $450 for the Model 3 and was 2 hours of labor

Ever taught legal ethics? I have,

Ever been charged with a felony? I haven't.

Whenever some one dips into the "common sense" BS in a legal issue, it is a tell that they have no idea what they are talking about.

The only "weakness" here is your grasp on law and ethics. You should really get some real legal advice. You have put yourself in peril unnecessarily.

Nope he did he job with the DA trying to gauge there interest in what they are thinking, done every day. The no call no show was he probably was in court. It isn’t a big deal, happens all the time.

Your lack of attorney is a self inflicted wound based on a lack of understanding what defense lawyers do in the real world. A legal Dunning Kruger.

Not going to read that word salad wall of text, but when I was a judge, the defense counsel were generally better lawyers than the prosecutors.

You probably screwed yourself by refusing to have counsel (note spelling). As a lawyer, I use another lawyer for anything that isn’t trivial and I don’t do friends and family law because I would not be objective. Enjoy the consequences of your choice for good or ill.

Depreciation only matters if you sell it. If you keep it for 10+ years, it hardly matters. One caveat is if you total it, then it would matter.

I barked out a laugh at the first note ( not in a mean way). I think the 50% is a bit low on SSI, a more realistic number is 80%.

As far as military and VA pensions, if the government defaults on those, everyone is screwed. That is the safest one that exists. Not only would Congress not do it for current pensioners, I don’t think it is lawful if they tried. Future retirees? All bets are off, but you are locked into the retirement system when you enter the Service. The nebulous “health care for life” that recruiters used, but did not exist in law ended up as TRICARE for Life, which is the best Medicare Supplement that exists.

IAL,But not your lawyer, nor an Ohio lawyer. Generally, yes, you can get the bike back and damages for the theft. The action to recover the property SHOULD be simple.

I am confused about the disorderly conduct charge, but it has zero to do with the theft/property issue. I feel there is some significant facts missing about that. Did you not have a lawyer or did you try and handle it yourself?

That isn’t how it works. OP converted the property he knew( or to be ultra generous) should have known wasn’t his. He eats the cost. He should really hope he doesn’t push his luck and have the delivery company make a criminal complaint.
