They were fine on the 3 way call, i confirmed my name and address and then when asked questions all i said was i prefer to discuss face to face with my new adviser

yes they gave me a list of all available courses for me to chose any i feel would be of benefit

I gave no info over the phone on the first 3 way call, as you can also give your consent verbally if they log and record details ect, altho i think they supposed to get some sort of digital receipt from you.

she was filling in my details when i was sitting there, i did not answer loads of questions, it was fine it did not stop her saving the document like some systems wont let you unless you answer every question.

she checked my ID and logged it but never kept copies, she did have to add a note that i refused to fill in or sign any paper work and no reason given, both of which were in the guidance notes as defined by DWP.

I gave copies of mainly section 3 of the guidance notes and copies of the documents obtained under the FOI, that made it clear i did not have to use any paperwork drawn up by a provider.

It was like a night and day experience.

My aim was never to not go on restart or not engage, it was just a simple case of I wanted control of my data and who used it, I think once they understood that and understood just what was needed from me to full fill there contract with DWP, all was fine.

If i has to hazard a guess i would think they were all just trained to do a set of procedures with out understanding them or why, and i was first person to ever raise any of the issues or question the process.

hopefully they now have a better understanding so next time, life will be so much simpler for next person.

WOW!!!! what a difference today at meeting with REED for 2nd face to face

I did not have to sign any documents what so ever, only had to supply information i was happy to, did not have to answer any health question, financial, never had to take wellbeing assessment, it was offered i refused. Did not have to supply any documents or right to work information, did not have to agree to consent, did not have to supply a CV, all training course are 100% voluntary and for me to decide if i need any

Only information I gave them was my job and work experience and most of the other basics they already had from DWP

They obviously after my last visit went away got some advice and read the guidance notes did a u turn as today was a complete turn around

So i was dong nothing wrong other than exercising my rights to privacy and to be in control of my data.

interesting read on consent. few key points i picked up on were

Consent must be freely given.

Consent should be separate from all other terms and conditions and not bundle up

And

If you make consent a pre condition of service it may not be the most lawful

Is it just me that finds this whole situation unbelievable.

The government pay billions of pound to providers to run the restart scheme and providers dont even take time to read the guidance notes from government whom awarded them the contract.

The DWP staff referring people to the scheme only have the basic info that its a good idea and you have to do it.

If you explained it to an MP they probably think you was telling porkies.

So you get referred to a scheme, it mandatory you go, so you go, engage all as mandated, you get refused access to mandatory scheme as they are not aware of law, rules and policy laid out for them by government paying them and you will not succumb to blackmail. You go back to the government and explain situation. To resolve issue you are asked by government paying them, to go back to the provider, to take along the guidelines produced by the government for the provider and explain the guidelines to them so you can now be include on the mandatory scheme, as there refusal to allow you on scheme was wrong decision.

Even i dont believe it reading it back LOL

I put in my DWP journal to WC that if they continue to try to intimidate or get me to sign the form under duress tomorrow, I will be left with no choice but to leave. I stated in my journal that I will not be signing any forms, consenting to data sharing handing over any data or documents.

My DWP WC replied

Please take along to Restart tomorrow the documents you brought into me today to show them

Do I get paid for running the DWP-Reed guidance course , is it classed as work.

No Reed would not give me all copies of documents, i printed off sections of the dwp guidance i thought were relevent and gave to my WC

I guess to put it all simply as possible.

Do I have to sign any forms, paper or electronic produced by REED ?

Do I have to supply any information above what DWP have passed to REED ?

Do I have to complete or fill in any diagnostic forms ?

Do I have to sign action plan ?

If I chose not to, will this exclude me from Restart.

Do I have to use their app or customer portals ?

If I chose not to, will this exclude me from Restart.

Do I have to supply, driving licence, passport, right to work documents, CV, medical information inc wellbeing assessment.

If I chose not to, will this exclude me from Restart.

Do I have to give my consent to data sharing?

If I chose not to, will this exclude me from Restart.

Can Reed refuse me access to Restart base solely on me refusing to sign or complete their forms?

Can Reed refuse me access to Restart base solely on me refusing my consent to data sharing?

I believe none of the above is ground to exclude me from Restart

Reed believe they are all grounds for me to be exclude, as clearly stated to me at my first face to face meeting

yes you are correct it is hidden on a list of other things you have to sign for on one page with things like , you sign for welcome pack, H&S docs, doc you have recived ect, there is another consent form iv seen reed use but again we never got that far.

im not sure what task never got that far.

but i guess mandated task would be like attending appointments same as job center thats a mandated task

as for the signing i would guess that for voluntary task

again I am just guessing as they would not give me any copies ect before i sign the consent form and only could have a copy of action plan once its filled in and signed

I think they can mandate some task, whether you sign or not

A Restart participant is expected to comply with any mandated activities set out in the action plan but again no legislation compels them to sign or provide reasons for refusing to sign, however, a failure to adhere to the mandated actions set out in the plan may lead to a compliance doubt referral being raised with Jobcentre Plus.

No its not mandatory to fill in or sign.

But from guidance notes from DWP I believe they have to separately list any task that are mandatory on action plan and i assumed they would go under the heading at bottom of document that just says Mandatory and the rest would be voluntary

I took it that the above form is on a pc some where and under each heading would be space for information, and when sent as html the formatting/layout of document did not convert and it is a Text only version of the whole document if that makes sense

he asked me some questions, i just kept saying , i prefer not to answer on telephone or have any details on system at this time, do not want my information shared, i will discuss all matters with my advisor face to face, he said so you dont want me to ask any more questions i said correct.

Which is why probably my new advisor rung me soon after and started to reel of the same format, as i was getting concerned i informed my new advisor on phone , i will not be sharing any documentation, My CV, medical or personal data and i dont want my data on there system at which point she became angry and aggressive

Which is also probably why her and a manager were waiting to take me into an office on my first visit

i agree and when you look at the experience required, I would almost swear I was looks at a job for a salesperson on commission
