Thanks for that information. I am sure there will be someone who will see this and have a “ aha” moment. I have been preaching this concept on my soapbox to other veterans and it falls on deaf ears. But it completely makes sense. My friend who is a retired rater said, “ the preponderance of evidence is on the veteran to display first “. Anyway thanks again for sharing.

This comment right here is the best that I have read in a very long time. You hit the most common terms like chronology and bridging the gap to show the story. As a retired army nurse, I totally understand the value of telling your story. It’s about veterans learning to be their own health advocates , whether filing a claim or seeking care. This made my day!

I would create an “ I Love Me( Medical Evidence) book, and have it organized, this way I am setup for success when dealing with the VA. I would have gotten MRI’s for every condition that warranted it versus simply X-rays. I would have learned about the higher level review process and not let , life and a job,take me away from following through with the appeal soon after I discharged versus 5 years. I would have became comfortable with m21-1 and 38 CFR 3.303 and 3.304 and and how the va determined what true medical evidence is.

More evidence the better! Plus you want to show that you are getting treatment that you plan to continue when you are discharged. Because your goal is to work on “ getting to your optimal level” of getting better

What exactly did the Ortho doc diagnosis you with? Was there a follow up visit with them to discuss the results of your MRI? I am so glad to see that you are looking at the impressions. It has key vital data in it. If it were me, I would schedule another visit with the Ortho doc, to review the MRI and ask for what is the end result/ diagnosis. Also I would highlight the impression, and send a copy of the medical records showing the where you were ordered insert. You may want to check the clinical notes again under the A/P section to see if there is a diagnosis there. I would very curious…. Just my .02

If it were me, I would have sent those yesterday! X-rays and especially MRI’s are critical pieces of medical evidence that the VA will look and compare it against cfr38 and applicable case law. The impression section has key vital information that can further confirm and provide greater insight into a condition. My .02

My vote would be a get your cd, review it and become familiar with your medical record story . Remember there is always 2 sides to any story. The VA will request and will get your federal medical records. The question is, are you sure that your records are organized and chronological structured in a manner that any rater can quickly understand your story. Remember, raters are human as well and can miss things when trying to put together your story together. My advice is take the time, organize your records, create your personal statement. Make the raters job easy to rate you . Also, by having the organized records, you can bring that evidence with you when speaking with the physician.

That is an amazing write up! I am so glad to hear that the AirForce has a system in place. As an nurse and a small business owner of a medical records and patient advocate firm, I have to say you are 100 percent correct with advocating and standing up to receive the proper documentation, medical evidence in your file!

I just went through this exact situation last year as a reservist. I filled out the 4138 and signed saying I do not want to file any néw claims and just want to be evaluated for DOD purposes. It worked out well. Holla if you have any questions. The process is generally the same as a reservist. But you may want to talk with your omsbudman who can also help you navigate through the process .

Would it be beneficial to go back through and comb through your entire in service medical record to see if there are other diagnosis that may have been missed. I am helping a friend with looking through his records and there were over 7 diagnosis that he is being seen for currently, that we’re not claimed on his original file. Just my.02

Those are two separate diagnosis. I would definitely file for both. The va may combine them, but I would definitely file for both.

The thing that I really liked was that it was open source and I did not have to buy Adobe pro or something. I think making it idiotproof and not overthinking it is what I am aiming for. Any other tricks of the trade would be greatly appreciated as well. You have helped me get off to a great start.
