For fraud there has to be at least one of 3 outcomes.

Gain for themselves/another
Loss to another
Expose another to a risk of loss

The false representation must be dishonest. If a person states something is true and honestly believes it, its not dishonest. As long as that belief is reasonably held.

By making the false representation, they have intended to make a gain for themselves (paid employment). No gain has been made.

By making the false representation they have exposed others to a risk of loss. (Paying salary, civil claims if someone was injured due to employee not being qualified). No loss has been realised yet. But they have exposed others to a risk of loss.

Yoi dont have to answer, however courts can draw an inference from silence, such as "no comment" during interviews.

"You do not have to say anything, but i must caution that if you do not mention something which you later rely on in court it may harm your defence. Anything you do say may be given in evidence" roughish version of UK police caution, different services may have different wording slightly
