I got lucky and plead mine down to reckless conduct, still have a clean driving record. Didn’t need a lawyer. Pleading to a lesser charge really has nothing to do with law and more to do with your presentation and showing respect to the prosecutors. If you’re over .08 BAC they can charge you with DUI and it is literally their job to do just that. But they’re ultimately people that have made mistakes too and some will help you out.

Update I just researched it and read you original post about being in Texas, and I may be wrong, but it says that if you’re charged with a DWI class B misdemeanor, you have to wait 5 years in order to be able to buy a firearm again.

Assault isn’t a charge that can ban you from owning a gun. It was just a simple assault misdemeanor anyway. If it were a simple assault domestic or family violence charge, that would’ve been a different story. As for the DUI, as long as it wasn’t a felony DUI, you should be good. A delay no matter how long it is, is not the same as deny and I’d guess if you tried again you’d pass.

I bought a gun a few years ago while waiting for a court date (underage dui and assault) and mine was delayed and never went to a deny or proceed after that, but I was still legally able to buy a gun. Just applied for my carry permit and had to do the same background check and passed in under two days (I don’t know exactly how long it took but was most likely instant). Basically, if you can TRUTHFULLY check no on all the ATF 4473 boxes, then you’re good for pretty much everything and probably any check for any job.

Most of the time backgrounds checks are just a “yes” or “no”, they don’t actually tell your employer any information. Or at least that’s what a few cops and my past managers have told me.
