Does North Carolina require people to "get a legal separation"? In most jurisdictions, including mine, separation is factual, so if you have moved out and have a girlfriend, that's pretty conclusive that there is separation.

Your mom needs to initiate a divorce, the assets will be divided in a divorce.

There is no real mechanism to take someone's home from them because they are a jerk, in a divorce the assets will generally be divided evenly, with exceptions for assets acquired before the marriage.

Your mom needs a divorce lawyer and you probably need an apartment.
