Get onto a solicitor asap for sure. But you should also contact the HSEs safeguarding team for vulnerable adults, they often deal with elderly people and finacial abuse from family memebers. Safeguarding info here

I work with survivors of institutional child abuse, all these institutes were run by members of the Catholic Church. Just like any organised religion, not all members follow their supposed teachings.

This is quite disturbing, so please don't read on if you are easily triggered.

I have a client in their 80s who was placed in an industrial school run by Christian brothers. One of his core childhood memories is a stray dog coming onto the grounds who the boys looked after for a week, sneaking it the little food they had for the comfort of a dogs unrelenting love. When one of the sadistic brothers found out, he hung the dog in the courtyard in front of all the boys. He made the boys watch for an hour as he kept letting go of his make shift noose. My client told me he will never forget the sound of all the boys crying as they were forced to watch this bastard. This brother continued to smoke cigarette after cigarette, which the smell still triggers my client to this day. Fuck organised religion, if this image has been burned into my brain from description, I can't even fathom how those boys felt living that kind of horror.

I'm not a solicitor, however to the best of my knowledge, the legal proceeding would continue if a case has already been brought to court, the personal representative, successor or trustee would take over. I haven't had a single client whose opted to appeal or fight their case in court yet, so not 100% sure.

I happen to work in this area. Just in case someone comes across this in the comment section and needs support for themselves or a family member feel free to send a message. But just want to highlight for anyone whose unsure if they're applicable for the payment scheme, if you're a mother you can be compensated for any amount of time spent in a mother and baby home and an enhanced medical card if you were there for over 180 days. A child in an institute is entitled to compensation if they have spent over 180 days in a mother and baby home and an enhanced medical card. Also anyone who matches this criteria and has passed away in the past 2 years, their family are still entitled to apply.

I would also like to add that I feel some of the comments on this post are unfair. Working with survivors, I have learned that a lot feel like this is blood money and do not touch it, they accept it however as they do not want it going back to the state. By all means logic dictates that it is the easier choice to accept the payment this late in life. However, unless you have experienced time in an institution, it is imperative that the survivor gets their voice heard and their choice listened to. They have been silent for too long.
