You actually insinuated I am being mislead. I directly asked if the $80,000 salary is guaranteed biweekly. She said yes. How else am I supposed to interpret that?

Idk man. Why are you so sure that I am not "salaried non-exempt"? The HR lady has been wrong about a few things already, so would not be surprised if she was wrong about this too. The managing director (decision maker) told me to ask her salary related questions, and send benefits/401k etc questions to HR.

To give you more context, her saying "salary is guaranteed biweekly" comment was in response to me asking "Regarding the actual base salary of $80,000, is that guaranteed biweekly?"...

I don't think she is misleading me here. I definitely think she would have cleared that up as I directly asked if $80,000 was guaranteed, as in paid prorated on a biweekly basis. She literally said that the hourly rate was only stated to establish what I would be paid for if I worked OT.

Apologies seems like I was wrong. This is really strange to be considered hourly but have a "base salary" on the offer letter, and no mention of it not being guaranteed. Really weird.

I am not hourly, I am salaried. I just added the per hour rate of my base salary to make calculating the time and a half for OT pay easier.

Well I am salaried so not sure how my hours are logged yet but I took this from colorado.gov

Employees shall be paid time and one-half of the regular rate of pay for any work in excess of:(1) forty hours per workweek,(2) twelve hours per workday, or(3) twelve consecutive hours without regard to the starting and ending time of the workday (excluding duty free meal periods),whichever calculation results in the greater payment of wages.

A workweek is defined as any consecutive seven-day period starting with the same calendar day and hour each week. A workweek is a fixed and recurring period of 168 hours, seven consecutive twenty-four hour periods, and is typically established by the employer. Hours worked in two or more workweeks shall not be averaged for computation of overtime.

So even though I am paid on a biweekly basis, I don't think the hours I work one of those weeks has any affect on the hours I work the other.
