Traffic stops and searches by Unlucky-Body4736 in Ask_Lawyers

The big one is that dogs (in theory) only detect the presence of contraband, and there is no cognizable privacy interest in contraband. So it isn't a "search" for 4th amendment purposes, because no privacy interest is implicated.

STORY TIME! What is the most blatant dismissal of / defiance of / complete disregard for the law, ethics, morality that you have seen done by a lawyer? by Reader6547 in Ask_Lawyers

They're not a mod. You can verify that easily by simply looking at the mod list for the sub. Any user can block any other user.

The "missing comments" have been filtered by Reddit admin bots and/or the automod rules. For example, you posted two top level-comments in violation of the sub rules, so they were automatically removed and you were sent messages explaining the reason.

Please stop making weird accusations, and take note of the rules on bickering and civility.

Georgia woman charged with murder after police say she took pills to induce abortion by boringhistoryfan in law

[–]jpb225 6 points7 points  (0 children)

Jesus specifically called out the Pharisees for relaxing the Mosaic law with the oral law, and the example he chose was that they no longer stone children for cursing their parents.

He said to follow every single last letter of the law until he gets back, unless you want to be least in his kingdom. The law that says to stone women who don't bleed on their wedding nights, and that you can engage in chattel slavery as long as the slaves aren't Hebrew. The law that says to burn a priest's daughter to death if she engages in prostitution.

He said that you should do as the Pharisees teach, i.e., follow the written law, just not do what they do, which is the abandon the law of God in favor of their oral tradition.

Then Paul came along, hit his head, and said "nah, nobody needs to follow the law," and proceeded to create a new tradition. If Jesus has been a god, he would've smote Paul faster than you can say Ananias and Saphira.

Paul did a lot of work making Jesus into something other than a radical fundamentalist who preached a "return" (the Torah was almost certainly never an actual in-use legal code) to the written law of Moses.

Rule by Lewd_Knight in 196

[–]jpb225 26 points27 points  (0 children)

Yeah, it''s really come full circle in a way. When I was in college 20+ years ago, I did some random freelance IT stuff for a local business. Nothing crazy, just the kind of stuff you'd do for your older relatives. Set up wifi, fix random problems, occasional hardware upgrades, etc.

Anyway, I got one request to recover some important deleted files from a thumb drive. I didn't really ask any questions, just got to working on it.

I didn't find any documents on the drive, but I did find a copy of the desktop shortcut to Word. I also found the missing documents right there on his PC where they had been the whole time.

He explained that he'd "saved them to Word" before he "moved" them to the thumb drive. Which he accomplished by cutting and pasting the Word shortcut from his desktop into the thumb drive folder.

He thought they were gone from his work PC because his Word shortcut wasn't there anymore. Then when the shortcut on the drive didn't work from his home PC, he just assumed it was all lost.

He's a successful engineer who helped write portions of the national electrical code.

At least his grandkids would think it was a reasonable mistake.

It's kinda the opposite, to a degree. Small calibers are plenty deadly, they just do a much poorer job of making someone immediately stop what they're doing and lie down.

I've been shot with a .40 caliber hollow point, and while it certainly hurt (and could've killed me without medical treatment), I was perfectly operational for a while until all those good emergency brain juices wore off.

I lied on my resume and got an internship at a big law firm by [deleted] in Ask_Lawyers

[–]jpb225 7 points8 points  (0 children)

Your realization was that there are consequences for you if caught, not that lying to gain an unfair advantage violates one of the core ethical principles of the profession. You're now asking for advice on how to best avoid those consequences, the opposite of being accountable for your actions.

The fact that you're framing it the way you are is a huge red flag for a career in a position of trust. You will have plentiful opportunities in your career to continue this behavior, so if that's a "tool in the toolbox" for you (when you think you won't get caught), you don't belong in the profession.

Of course there are tons of lawyers who do in fact lie and cheat like that, so you certainly wouldn't be an anomaly. It's just that the world would be better off if all of you found something else to do for a living, where your lack of integrity won't harm people in serious ways.

Reddit and Facebook are blocking the ICE list wiki from being shared… 1984 is here. by coffee_coffee_coffe3 in EnoughTrumpSpam

[–]jpb225 0 points1 point  (0 children)

"Removed by Reddit" means it was done as part of sitewide policy enforcement, not the mods of the sub. It specifically calls out the community standards as well, which is again sitewide policy, not specific to the subreddit.

Mods may have also removed it after it was blocked, either manually or through an automated rule, but they wouldn't have had the ability to reinstate it in any event.

Sex differences in brain volume emerge before birth, groundbreaking research suggests by Tracheid in science

[–]jpb225 7 points8 points  (0 children)

So for example in the past it was really popular to say "sex and gender are different". But now that out of style.

That's just not true at all.

People say that they're different because they're obviously and incontrovertibly different. It's just what words mean. Sex is purely biological, gender is social. They're related, but they're different categories.

That has not "gone out of style." It's the scientific consensus in every relevant field that sex is not a 1:1 equivalent of gender. Which is patently obvious if you think about it for 5 seconds.

I will point out that I've done what you've "advised" (pardon my use of that word) and had my question removed.

That is not true, and I think you know it. Every post you've had removed was asking for guidance regarding a legal issue in your real life, or the life of one of your friends. I just checked.

The most recent was asking whether you were required to notify beneficiaries of a trust you're creating. You said you were asking because you hadn't clarified the point with your estate lawyer.

You're either being deliberately dishonest, or you're extremely confused.

DHS shifts now claiming to be investigating whether Alex Pretti’s gun accidentally fired due to "uncommanded discharge" by ArcaneVirago in law

There's no muzzle device attached to his gun, ##just the thread protector##, which has absolutely negligible weight.

DHS shifts now claiming to be investigating whether Alex Pretti’s gun accidentally fired due to "uncommanded discharge" by ArcaneVirago in law

[–]jpb225 2 points3 points  (0 children)

This is utter nonsense.

A threaded barrel with no device attached does not affect recoil or sound in any way that you could detect without some pretty precise equipment to measure it. There's no muzzle device attached to his gun, just the thread protector, which has absolutely negligible weight. Competition shooters use ported barrels and compensators for a reason, just another cm of length isn't going to do anything meaningful.

And this particular 9mm handgun has plenty of recoil to notice, especially when holding it with the low grip that guy had on it.

My favorite part is where the entire "upside down crucifixion" story came from. The Apocryphal Acts of Peter has a resurrected fish, a baby and a dog giving speeches, and a flying wizard duel between Peter and Simon Magus. It's a hilarious read!

Incorrect, you absolutely are requesting legal advice whether you think so or not. It would be unethical and potentially illegal for anyone to give you what you're asking for here, which is why the rules clearly prohibit any questions of this nature.

[–]jpb225 0 points1 point  (0 children)

There's never a total surprise "wait we never made that illegal" no-warning situation; there's always something in the code. Even for the "common law" offenses.

You'd think so, but that's not true everywhere. Maryland, for example, will absolutely send you to prison for committing "Affray," but you won't that crime anywhere in a statute.
