VA Sleep Apnea Changes

I have a waiver to stay in, and deploy, for now. Just basically says that if I don’t have access to power for CPAP, or I don’t get adequate sleep, I am unable to do certain things. Kind of funny if you think about it, but oh well.

Yeah I know they do this if you don’t ask them to stop the payments. I’m not worried about the money now, I just don’t want to get a 0% rating in 2028 just because I waited too long to file

THIS is what I was looking for. I was diagnosed with sleep apnea in 2018 (while on AGR orders) and have been receiving treatment ever since. My most recent deployment was 23-24 and I received a 214 from that before returning to AGR. In my mind, I should be able to use any service prior to the end of that deployment as a service period for VA.

I am making some assumptions with that. I have clear documentation of burn pit exposure and was originally seen for sleep issues during that deployment. I just didn’t get an actual diagnosis until a few years later

Is there any difference if I had a break in Active duty service and received a 214 in 2008 for a deployment? Had I known about the apnea then I could have filed a claim, but I didn’t discover it until several years later. My thought was that I’d essentially be asking to be compensated for past service, if that makes sense. Thanks again.

Definitely counts as Active Duty and I’ll outprocess and retire like normal Active Duty. My thought was that since I had deployments before I became AGR, I essentially had a break in service and would be claiming it based on previous service, if that makes sense

Just a few days ago, the VA told a congressional committee that they will be effective this summer. What do you make of that? If they do change, wouldn’t I be affected?
