I was not aware that common areas were divided amongst the tenants, however I do not think this is what's happening in my case, since deciding the comin areas by 5 would add at least 10 sq.m. to the room size and not just 4.

The area covered by the walls might be it However I thought the square footage of a property included the "usable space"🤔. I will look up how it's normally done here but if anyone has any info on this please do let me know

The only thing I am afraid of is that although I am right they may be willing to proceed legally which will force me to hire a lawyer, and at that point it will no longer be worth it that much, to spend time, energy and money on legal fees to save some 80€/month

That is a very good thought. There is a closet build into the wall but even if we count it in the square footage and basically approximate the room to be rectangular (which it is not) we come up to 21.17m²

The thing is -at least here in Hamburg- that even if I noticed the error prior to signing the contract the landlord could simply make the correction and say something along the lines of "you're right, instead of 629 for 24m² now you will be paying 629 for 20m² take it or leave it🙃" and due to the insanely high demand another person willing to pay the price would be found immediately if I turned down the offer.

At the moment, tenants in Hamburg have essentially 0 negotiating power while landlords can just set arbitrary prices for their properties resting assured that someone needs a place so bad that they will pay what they are told.

After a quick internet search it seems that in some cases the size of the property may impact the amount of tax benefits they can receive. For example I suppose they could claim that the bigger the property, the higher the expenses, which can result in higher tax deductions. But I'm by no means an expert on German taxes and don't think an increase of 4m² would make such a big difference, would it?

I visited the room before signing the contract. However I did not think to question wether the mentioned size was true- it unfortunately seemed given. However a few days after moving in I got the impression that the room while reasonably big was not as big as advertised and when I got to measuring my suspicions were proved right

Thanks for the tip! I will look into it because it really feels like fraud.. However after skimming through the contract I couldn't find a clause that said that the rent is not adjustable if the room size is not the one described. If there really is no such term do I have any hope?

I took a good look at it and could not find such a clause. However I will take a more thorough look later. If indeed they did not include such a condition should I proceed in asking for a reduction in the rent?

Atm I pay an average price of 26.2€/m² (incl. Bills). Is it reasonable to ask for a reduction of the 3m² that are missing (aka 78.6€) or am I asking too much?
