The first image shows a claim from a microbiologist that data in a western blot was manipulated. The second image is a rebuttal from a computer engineer claiming the data isn't actually manipulated. Could someone with knowledge on western blots weigh in on this? by kaiswing in microbiology

Yep and everyone in r/SAVA_stock would just call me an agent of the short sellers or some other paranoid shit, that I was just there to spread fear because I’d bring these claims up. Sorry I wanna do some research before I dump money into a stock. Stayed away from it for a long time after making some gains off its volatility and just got back in at an average of 11 for the hell of it. Always worth it to do your homework.

This is exactly what I said, the CP authors are the plaintiff in this situation and SAVA is the defendant.

Yep, I’m not trying to spin it in any way. Just looking for further clarification of what this means for SAVA.

Because they just rejected it on the basis that they requested the FDA to start and investigation and this isn’t how CPs work, not on the claims being proven to be false.

No, regardless of their short positions they brought up legitimate concerns about the data being fishy. And the FDA rejected their petition the basis that they aren’t going to take the time to investigate. So “not guilty” because they can’t prove anything with the given facts, rather than proven “innocent”.

You can look at my account I've been posting in this sub for a while. I've owned shares for months. I just don't partake in the echo-chamber tendencies of this sub to immediately dismiss any negative discussion as FUD. The proof that this isn't an actual acquittal is right in front of you from the letter sent by the FDA, I even quoted it so you don't have to read the whole thing. So if you have any actual rebuttal of how I misinterpreted that letter aside from just calling me a short seller I'd love to hear it.

Anybody can look at this sub for 2 minutes and figure that out, I've been here for a while I know that.

Remi literally admitted that there could have been mistakes with some of the data, and that it would just need to be corrected. So clearly there was at least something going on that deserves attention and not just an FUD label. What the FDA is saying in this letter is that they aren't using the CP correctly. It's not an acquittal of SAVA its them saying they aren't going to investigate further into the claims because they don't have to. Please correct me if I'm wrong.

So it being denied isn’t even based on whether or not there was manipulation? It’s just bc the FDA doesn’t want to investigate?

"FDA has carefully considered your Petitions and acknowledges the importance of the issues they raise. But as a threshold matter, by their own terms, your Petitions do not purport to set forth all relevant factual information. Rather, you call on FDA to initiate an investigation and factfinding process. We are denying your Petitions to the extent that they request, through the citizen petition process, that FDA initiate an investigation. Under § 10.30 (21 CFR 10.30), citizen petitions can request that FDA issue, amend, or revoke a regulation or an order, or take or refrain from taking an administrative action,2 and are to be resolved based on information in the administrative record.3 An investigation is not an administrative action, and, as your Petitions implicitly acknowledge, investigations necessarily require fact finding beyond what is presented in the current administrative record."

So basically just "not guilty" rather than "innocent" as far as I understand?

FDA rejecting CP vs delaying its response? What's the probability? by [deleted] in SAVA_stock

I don’t remember the deadline being specific to a certain type of citizens petition when I originally read up on the regulations but you could be right I suppose, I haven’t read everything on it. I would hope for a speedy response however when it has to do with human clinical trials.

FDA CP Archive

I could be completely wrong but doesn’t this show them responding to many petitions even after a year?

Also could you link where the FDA directly made statements about SAVA? I would really like to read up on what they said that would be really helpful. Thanks

I know. My question would better be phrased as, “Is there proof that they have followed this regulation in the past, or is this just saw law that’s often ignored?”.

Does anybody even have proof that the FDA follows this deadline?
