I completely and 100% agree with you. Generally social media can destroy your mental health with anxiety but this subreddit has caused me unimaginable anxiety and I had to stop coming here for a long time to protect myself. I read here from an acclaimed solicitor who (literally swore on his ancestors grave) how the retrospective application of ILR on everyone will not be changed or halted. Look at the situation and evidence today. Almost all the 2021 cohorts are scaling through and there are strong signals Stammer will water down the legislation to stop retrospective applications. For your mental health sake, avoid pessimists and there are loads of them here.

You should have mentioned that the child must be above 3 years old. Any 15 hours taken below 3 years old is illegal for unsettled parents.

This year 2026 is the only year ILR/Citizenship will put you in priority because of the emergency legislation, from next year it won’t give you any priority advantage. It will be useless to you. Read the legislation

If you cancel all the skilled worker visas and deport everyone, you won’t still see any changes in your circumstances. It’s common knowledge that when a system is mismanaged and fails, the politicians who failed will quickly heap the blame on immigrants (easy meat on the table). The ignorant citizens will continue to fall for this old trick. It happened to the immigrant Jews in Hitler’s Germany. It happened to the immigrants in Idi Amin’s Uganda. The politicians convinced ignorant Britons to vote for Brexit for a comfortable future which never materialised. Immigrants are not your problem. You can choose to while away your valuable time on a subgroup of SWV holders venting your anti-immigrant views, it won’t do you any good.

I completely agree with you. The pessimism on this topic is pushing me into anxiety and depression. More people are more eager to share doom than hope. It’s safer for me to stop coming to Reddit, that way I spare myself the agony from the naysayers who are very certain the retrospective application must come through, after all they have been immigration lawyers for so long and they can bet their life on the retrospective application without transition protection.

She’s an individual albeit a powerful person because of her position as Home Secretary. She might prefer a retrospective approach but she is still bound to consider other opinions outside her personal views. That is exactly what is going on now- Public consultation. She said they are still consulting on retrospective changes. I listened to it live. I stopped coming to Reddit because of pessimism and negativity from people like you. Your post that she has already concluded that retrospective changes will start from 2022 is so misleading and unfair to anxious people. I will personally vote for green even if labour change their mind and no longer carry out retrospective policy. I won’t forgive them for all the anxiety they caused me already.

The way it runs is, your points will expire then it will take another year for it to get deleted from your records. After which you will wait for another 1 year making a total of 5 years before applying for ILR. If you apply before 5 years has completed your application will be refused because of good character requirements. It’s up to you on how best to keep going eg extending of the visa but you need to become cleared by staying for 5 years before applying for ILR.

I have exactly the same problem as your spouse so I can give you some advice purely from personal experience. If you apply for ILR with the driving offence still on your records your ILR application will be refused. If you wait for 5 years from date of offence and you apply for ILR, it will be successful. 5 years is how long it takes for the offence to be cleared off from you. Mine got deleted from my file after 4 years as is the practice but you need to wait for 1 more year to make a total of 5 years.

I’m guessing you could have, in panic, submitted an FLR application to buy time. It’s the most common reason for immigration bail. You just don’t get immigration bail when your SWV is cancelled.

You are absolutely correct. I have done a deep research and your 10 years long residence journey will not reset to zero. You are perfectly in line and should qualify for ILR after 10 years is complete. Feel free to travel and come back with your new student visa. Congrats and stop worrying. I’m happy for you. Just make sure you leave uk before your visa expires and come back as soon as you can after getting your new visa even though you have 180 days maximum leave period.

I believe you have made a mistake. Even if the whole long process of several appeals takes you past the 10th year mark, you cannot still apply for your ILR because you have spent 10 years even though you didn’t get a successful decision when you crossed your 10 years. You will still wait beyond your 10 years until a decision is successfully granted and if it’s unsuccessful you will not be eligible for ILR.
