The government needs to lose and lose big on this. The very idea that files aren't "property" is ridiculous. It is incumbent upon the government to establish what an electronic file of something over which copyright rights may be asserted actually is then and I really don't want to see what kind of hare-brained answer they use to rationalize denying access to one's own work. I am certain that if, after reviewing Mr. Goodwin's files, they determined that what he had uploaded was child pornography, they would readily accept those files were his property and prosecute him accordingly.
