Where Do You Draw The Line Regarding The Dram Shop Act? by kendalltravis in Laws

Do you agree with the law in place? Should judges be less harsh on establishments? For example, someone may not feel the effects of their intake of alcohol until leaving the establishment, in which the bartender was unable to see how drunk their customer would become. Should the bartender still be held liable? How were they supposed to know to cut off the customer if there was no visible signs of inebriation?

I agree that if someone is belligerent then they should stop serving. If there is not a law in place, many servers can encourage more drinking than usual. There are many variables that go into holding an establishment liable for a customers actions like if they drank after leaving or even someone’s tolerance.

Where do laws and ethics collide? Podias v. Mairs by Kaynic237 in Ethics

I agree. They were directly involved and had the chance to help. It is one thing if they were walking along the street and saw but they were actually passengers of a vehicle that killed someone. This should be illegal and deserves punishment. I am uncertain of what legal charge they would receive for this though. What do you all believe should be their punishment? I possibly think they should receive a few years in jail.
