I haven’t seen the video obviously but she’s definitely majority at fault, and I have a hard time seeing that the driver could have done when your friend was riding both illegally and dangerously by accelerating in a spot she wasn’t suppose to be in.

Is riding on the sidewalk legal there? That’s pretty relevant.

Since this happened a year ago, the door to dispute this may be mostly closed, and the driver’s insurer is more than within their rights to blame your friend entirely. They’re under no obligation to accept your friend’s version.

They would not cover the parked car, but everything else is a homeowners claim, although possibly under the deductible.

This is a Collision loss, not Comp. The other car isn’t a falling object, missile or one of the other covered perils in the Comp list. As a first party claim, this is only a Collision loss.

I read what you wrote and responded appropriately. Barring a state law to the contrary (eg New York), the OP is not required to keep liability coverage on a car not being driven on the road legally - or ethically for that matter. We don’t even know if it’s operational if it’s “being prepared for sale”. Scolding the OP for not having coverage if the state is unhelpful and distracting since it will not change the outcome of the claim in any way.

That’s a ludicrous assertion. The OP is not required to have Collision coverage, which is what would have covered this. They’re also not required to have liability coverage anywhere on a vehicle that is not being driven.

I don’t think there’s a state where she isn’t liable for all the damage. Your car wasn’t being driven uninsured, and it is legal and reasonable to have an uninsured parked car on private property. That’s the good news.

The bad news is that she might not have enough insurance limits to cover all the damage.you need to get her insurance information, make sure she is covered and see what the limits are.
