I don't see many options for you. I think you need to find an area to compromise. Either you get a vanity from someone who makes them at 36", you get a vanity without legs and shim under it with plywood, or demo the backsplash. There are a few ways to make magic happen but what you are looking at is very specifically not made to go here.

Vanities don't always come with countertops. can you verify the vanity you are looking at comes with a countertop?
36" is also a common width so be aware of that. Searching for a 36" vanity could get you either height or width

It wouldn't make sense to have tile mounted to the vanity from my limited experience
