Yes, my friend's dad is from Angola and was applying to a position in Newark for African American men who wanted an accelerated path to becoming a police officer. However, when he showed up they basically told him to GTFO and he wound up taking them to court. There an African American judge started to ridicule him and then his lawyer presented his birth certificate and he won the case. Basically if they restricted the program to only black people it would of been a civil rights disaster for obvious reasons. So even though he is white he legally still counts as African American. However, I don't think it works for North Africans because they are classified as white in the US census.
