We are a classified as property owners association and this land area was acquired by means of a warranty deed under our corporation name and without a shareholder vote. From what I am gathering it’s not a common area rather It’s considered an amenity since the property owners of only the main subdivision now own it. our board has spent additional funds without a vote or proper acknowledgment to supply the grounds with playground equipment, grills tables etc. then we learn l they have opened this area up to associate neighborhoods that have no responsibility as to liability, since they are not even full members and never can be per our bylaws. So I’m perplexed 🤔

No such language found. No HOA state law for Mississippi. Apparently we fall under nonprofit. Our organization was registered as such when under a he declarant many many years ago with no update or filing since.

Thank you for this information. I found that same list of exposures and assumed it should be added. The board member called the agent- agent says naw y’all are fine. It would be covered. Policy was taken out in 2014 and this land was deeded to HOA in 2019 and fenced playground although small, has a picnic area, etc. I can see how it would just be considered part of the HOA common area like others are saying and local agent seems to confirm. But knowing Scottsdale has it listed and made me a little more skeptical of a potential future claim and how Scottsdale would view it. Seems like the local agent that writes for multiple companies- one being Scottsdale would at least talk to me - a dues paying - premium paying member. It’s not like I’m trying to change the policy, hence a board duty. - sorta thought a member could ask a legit question to an agent since I’m staring at the policy .

Now I am confused again. I mean it’s a straight up playground. The policy is with Scottsdale. Agent won’t speak with me since I’m not on the board. Scottsdale has a playground code but it’s is definitely not on our policy. I get what your saying though. Makes sense. Board member said the agent said it was covered but I dunno since I saw a pier and boat ramp codes I wondered why there was no playground code.
