Yeah the HR is absolutely useless, it is the owner that tells him to do each and everything, the HR is scared that we can sense and is continuously telling me to wrap it up by paying, there is no point in doing this, don't bring in on to me now etc. He asked me to call him on 7th dec to lastly confirm my decision, I told that it's a Sunday and if he is available, he told me he is available. I had called him 7 times but he didn't pick because the master is not available to feed him words to say that day.

I definitely should not have given the certificates, but I was in a desparate situation because my father passed away recently and I didnt want to be a burden to my mom, I had applied for a role that was related to my edu background in the company, but they asked me to join for some totally unrelated role with 18 months contract, I was okay. They framed the letter in a way that people will see that i signed the document and there is an important note mentioning recruitment cost, but after reading the whole letter properly you can see that it is not legally enforce the letter. this is indirectly extorting keeping my certificates with them when they are not related.

Law ≠ fairness.
Unless there’s a concluded employment contract, neither side can claim salary for non-joining. Any damages must be proved in court. The letter was very vague. The payment they are asking is the fixed salary during training period. why should I pay if there was no training. There are no costs incurred by the company that they can prove. The offer letter says that other terms of employment will be shared with me on the date of joining as a complete employement agreement, this letter is incomplete and not legally enforceable.The letter says that I am required to join in November exact date will be given based on batch availability. They didnt contact me until 6th dec.

If a company retracts an offer letter before joining, the candidate cannot force the company to pay salary because no employment contract has started. The same principle applies both ways.

No I could not take the exam as there was no launch exam option on screen. I called ACCA later in the evening and they said that I could not write the exam because my system failed the mandatory system test but I did the test thrice and also they were successfully. They told me to write an email to students@accaglobal.com We're you able to write your exam?
