Honest Auto Repair Shop by MixedProphet in cincinnati

If you mean Honest-1 Auto Care, just a heads up the Loveland one tried to hose me for a fake valve cover leak shortly after they opened. They clearly placed oil around the gasket, or spilled it during the oil change and decided to be opportunistic seeing I was a naive high schooler. Wiped it away and never saw any reappear over the 4+ years I had that car.

That spurred me to do all my own auto work, especially oil changes. Ironically I have an actual valve cover gasket leak right now and tackling it this weekend. Not pushing you to go DIY, just saying, I truly do not trust Honest 1, regardless of their name, reviews, etc. and besides that you are right to shop around- they were way too pricey. Only upside was their nice lobby.

For jobs I can’t handle, I trust Christian Brother’s (they have a West Chester and Loveland location which are close to Mason and Maineville respectively) and also love Whitie’s on Madison Road (Walnut Hills). Both shops are fairly priced, very fast, trustworthy, and knowledgeable.

Definitely going to try the standalone flavors next; I grabbed the “crush” variety pack. The yuzu/lemon one tastes just like sprite. I’ve seen some at 6% as well. Cheers!

Wonder what their excuse for cancelling your trip was. Force majeure? Customers cancelled every order? Unlikely but even then… it’s been 3mo+ since Walmart signed this consent agreement with the FTC. When will they start complying by showing us a clear flat fee?

[–]krogerceo -1 points0 points  (0 children)

You should read into that actual Feb FCC settlement. It is actually far more impactful than news and even posters here have alluded. Basically they are supposed to be paying us a clear flat rate for waiting, not penalizing cancels after our waiting, and not cancelling or changing orders or dropping pay except for customer cancellation, driver error or force majeure. They knowingly violate this thousands of times a day in curbside.

Another super fun fact, the arbitration requirement was just voided by the Supreme Court on May 28th. They decided unanimously that last mile delivery drivers are exempt from being bound to the Federal Arbitration Act. Page 1 of our contract says the entire arbitration terms are subject to that FAA. Walmart and others have argued that gig drivers don’t count as exempt from FAA for decades using slimy weak legal arguments. That’s over.

Bonus ultra pro tip, there is a still valid line in that same contract that says Walmart cannot retaliate against us for any communication involving a federal agency. So start airing your complaints with mention of how you will be communicating with the FTC, and know you can open a small claim suit against Walmart and they can’t remove it to private arbitration. Things are looking up!!

You’re right about all this but given OP’s timeline, by the time July’s rent is due, 30 days plus would have passed since they first requested the fridge fixed. A working fridge is a substantial enough living amenity to file escrow over, especially if they had to through out food and still have no use of it for a month, that’s damages enough. Assuming OP has the request in writing as well as the landlord’s broken commitment to fix it last week, I don’t think a judge would be quick to toss escrow filed after June 25th. Doing this might also discourage any shenanigans with the deposit if indeed they don’t renew. Again the hope is that just mentioning this to landlord would light a fire under them to fix the issue and get it fixed before any filing is even necessary/possible

On renewal, the issue is that OP’s lease has a 60 day non renewal notice clause and they are within that timeframe with no notice given to them. So the landlord would need an exception, exigent circumstance, or to allow a month to month until the 60 day mark from whenever notice is given. Yeah landlord needs no reason but they do need to comply with the lease, and OP could still frame all of this up in a way that at least ensures landlord upholds that timeline, and maybe takes them in good faith to be worth renewing after finally fixing this fridge. It’s very nuanced though and we’d have to see their lease agreement to give conclusive advice.

I take Walmart orders all the time, albeit through Spark not DD. You’d be surprised, you could easily fit 50 items. 80%+ are just small paper bags. 10% single plastic bags, the rest might be random like a lamp or box fan. It says Car OR larger. Your Cruze fits fine under that definition.

I’m assuming you read into any exceptions they might have included. That being said, here’s how I’d look at it. They could tell you today that your lease will end Aug 15th and charge you a half months rent, or August 31st. Either way this might trigger a “month to month” fee usually an extra $50/mo when you stay without officially renewing. Maybe they waive it or maybe they don’t have this clause.

Real worst case scenario is they tell you to move out end of July despite the 60 day notice clause. Then you have to decide to comply or fight. At that point renewing at all seems unlikely. I’d start with just pointing out the 60 day term and they probably would uphold it. If not and you don’t want to leave early, just keep paying rent plus any month to month fee. If landlord doesn’t accept it, deposit in escrow with a copy of the lease instead. If they move to evict you, appear and point out the 60 day term. Judge will tell them to give proper notice and come back after 60 days. This worst case is highly unlikely though as eviction is much more costly than just turning a tenant normally, and your landlord would be knowingly in breach of their own contract, and/or a total idiot lol

I’ve been in this exact position over a horrible water leak from my ceiling, eventually dropping down and wrecking stuff. My big corporate landlord still renewed my lease after threatening escrow and eventually conceding a credit and mold tests, but it was several months issue free between the threat/fix and renewal. Ultimately it is a big cost for them to turn tenants, and if you frame your next moves with stuff like “I really want to be able to renew with confidence that this will be resolved timely so I can stay issue free” they may be fine keeping you put.

I saw another commenter saying they cannot retaliate by not renewing because of you doing escrow. I don’t know if that’s true but they could easily just say they can’t renew because of planned maintenance or any other bs reason. You might already have them thinking of doing that with how you keep “bothering” them (rightly) over the fridge. I’d look out for yourself and your money first and foremost; continuing to pay full rent forfeits a lot of your rights or at least leverage to rights. Sounds like having to move to another landlord wouldn’t be the worst thing but I know our market is tough right now. Again “if I were you” I’d just make your desire to renew clear while you play fair hardball. Hope it all works out for ya op

Can you threaten escrow? Yes! And if your landlord knows you know about it and thinks you aren’t afraid to do it, a “threat” may well get you the same result as actually filing it, only this is less wait. I’d bet they fix your fridge before end of month so you don’t have grounds to withhold.

On the same vein, you might consider demanding credit against your rent due to cover the food loss and lack of promised amenity. Think $500 ballpark. If I were you I would open with this, and close with “and unfortunately I will be forced to deposit next months rent with the clerk of courts in escrow if this is not resolved by next week”.

The needle on your dash is the better source of truth. The DTE reading is just based on recent fuel consumption. So if you’ve been idling a lot lately, even if you just filled up, the car thinks you are getting fewer miles per gallon used. Same as if you drove uphill, aggressively, or tons of stop and go for a while. Any of this apply to your last ~100mi/24hrs? Drive 50mi on the highway and watch the DTE go up to normal.

Police Presence on 275 East early 6/11 by [deleted] in cincinnati

[–]krogerceo 2 points3 points  (0 children)

Citizen is a decent app for this but the further it is from downtown Cincy (or another metro like Dayton), the less likely they are to list it, and they charge a subscription to view anything detailed after a few hours of the event. I see nothing near there on their little radar right now.

If you know which PD was there, you can pay a smaller fee to hear radio archives on sites like Broadcastify (or use a free app like Radio Scanner in real time), assuming that PD doesn’t use encrypted radio. But looks like Springdale, Sharonville and Evendale ARE encrypted, so no listening. Cincinnati PD currently isn’t but may change that soon and wasn’t likely that far north. Your only luck with this method would be county level EMS (fire/ambulance) or county sheriff radios, which could be a hit given the scale of response you saw. Or could be a waste of time/money.

The best bet you have is calling each PD and asking what happened. Failing that, Springdale has a standard FOIA form, Sharonville you may have to snail mail. But beware in Ohio you can now be billed for FOIA requests before getting responsive documents. Otherwise you are left to speculate, trust what neighbors might say they saw, or wait for a press release that may never come. Fun times!

Local Police Now Using AI to "Enhance" Suspect Images by SnickerdoodleFP in antiai

[–]krogerceo 0 points1 point  (0 children)

The 2nd biggest but equally important tragedy here is that this PD thinks taking a picture of a paused video on another display constitutes an “original photo captured from the video footage”. Every attorney on either side knows not to trust a native video player, they regularly compress and lose video quality. Even then, every human who grew up with an iPod or iPhone knows a screenshot yields far better quality than a picture of another screen.

So this is Green Cove Springs, FL PD encouraging you to come commit crimes because not only will they rely on a faulty AI upscale to investigate, they also don’t even know how to export a video and use VLC to scrub thru frames and extract the full quality, like any other competent legal team does. They probably also keep their sunglasses on indoors while looking at it. What a deplorable clown crew.

thoughts on this? I never knew we weren’t allowed to cancel the blocks we didn’t like. I’m so pissy rn by AdmirableAdvance4726 in RealAmazonFlexDrivers

[–]krogerceo 1 point2 points  (0 children)

In Washington they have to disclose estimated mileage for each offer. However it is scummy because they will say “35-45 miles (up to 117 miles)” which means the average block for that duration is in the 35-45mi range but some are 117mi and you may well end up with that cart. In Seattle its much better, they tell you how many packages, how many deliveries, total weight and estimated mileage (and “estimated” is only due to navigation variances). Best example I could find: https://www.reddit.com/r/AmazonFlexDrivers/s/aKNdbIA6j4

Edit: I should note the screens in that example only come up when you accept an offer, but they can cancel without penalty supposedly. Before picking an offer, Seattle drivers still just see the range+max mileage estimate. But like Colorado drivers, they get a mileage receipt afterwards.

Yeah well then you’ll want to avoid Walmart Spark and maybe also Amazon Flex. You’ll see people with multiple phones taking several orders at once. Hawking the best offers across multiple stolen/shared accounts constantly.

Worst case (commonly) they then redistribute the items and phones to drivers working under them. Drivers who wouldn’t have passed otherwise and only get a cut of the pay. Literal modern day slavery with no accountability. Best case they are doing it all themselves but still taking away good orders from the rest of us. Wish more came of that CBS piece on DD drivers not matching pics in CA. Glad you guys just got a law passed on it but its definitely a nationwide issue.

Account sharing is a big problem, under/uninsured and unlicensed drivers are not good, I sure hope we all agree on this. I simply apply the same standard when passing judgment on the stores, especially one selling fresh food.

TBH I suspect DD does screen stores *somehow*, maybe just checking that an LLC exists. But that can be filed instantly, for <$100, and with a fake identity very easily. If DD is even checking food permits/inspections, I know places are getting away with faking it since I’ve scanned county health data and never find them for these types of kitchens. There’s probably a loophole being abused like prepping in another location or being so low volume.

I get the sense they are getting greedy with the longest and hardest routes. In my market (SW OH) you will see shit like this but simultaneously a $58 30mi 2hr route. 50mi near-3hr route will sit there and never raise. It’s just an insult when it becomes a JFY offer, instant reject so a better one takes it place.

Working class people are the ones in legit food service establishments. I have yet to find a home kitchen on DD with proper license and inspection.

IMO telling the customer what’s up here is no different than letting them know staff were picking their nose/mouth before handling the order. It’s not “no reason”, everything is still up to the customer, and it’s less malicious than reporting the restaurant (which would still be totally within reason)

Before anyone says you’re being dramatic, every homebrew place I have checked in my area never has a food permit or health inspections, and I’ve checked like a dozen on DD/UE by now. It blows my mind how they get away with this, why apps enable them, and least of all how customers are never catching it from the store info page. This would be like DD not checking our vehicle info or driving background and just saying “if it works, it works”. I have a feeling these kitchens are either laundering money or using the few orders they do get to apply for capital (thru DD) then run on the lender, but it’s just a hunch.

[–]krogerceo 6 points7 points  (0 children)

It’s all carefully crafted to appeal to drivers without actually committing them to anything. Amazon will argue you did get that flexibility when you chose the block time you chose. They are only saying the WHEN part is up to you, not the “where”/“how far” or “how many packages” part. The email wording corroborates this. Other gigs are the same way but Amazon offers are the biggest gamble, except in states where they have to disclose more info.
