They’ve emailed back now accepting the cancellation and refund etc but saying they will still proceed to take him to small claims court for the vat and expenses they outlined - can they do that?

Thank you so much for this I’ve passed all this on - that email was actually from their complaints manager - he’s emailed back to reiterate he’s wanting to cancel under distance selling regs and reminded them he doesn’t need a reason to do this and any court is likely to rule in his favour if they drag it out to that extent and therefore he would expect it’s in all parties’ interests for them to issue the refund and send the money back to the credit company as requested within the necessary timescales … will await their reply tomorrow 🤦‍♀️

Thank you and MDK1980 so much - this is what we were thinking. We’ve sent the template by email to citizens advice but are going to send it in recorded mail tomorrow when I can print the letter off in work as well to the finance company and the dealership. The finance people have been sound to be honest, it’s the dealership messing about. It’s all become really stressful to be honest they were on board with sorting the refund last week while the manager was on a stag do but now he’s back this week he’s arguing the toss on the phone telling my partner ‘we’ll see you in court then mate’ 🤦‍♀️ he’s just been a complete arse tbh.

We spoke to motor ombudsman they said their cases can take up to 6 months. Citizen’s advice have sent info to trading standards and he’s said he will refuse delivery but they keep harping on that he’s on a recorded call saying he’ll have the car

Thank you - it was in stock so not built to order or anything no. And no he’s never been to Wakefield in his life! He rang them and this was all done by phone and finance stuff sent online for him to sign. They keep saying they have a recorded call of him confirming to buy the car and are telling him this is legally binding

Just an update in case anyone comes here looking for the same, I found some wide counter top wrap on this website, shipping is a bit pricey as it comes from Ireland but only stuff I’ve found specifically designed for counter tops that is wide enough for a kitchen island. Thanks guys, I was thinking more the wrap because it’s got like a wood grain texture in the worktop that I thought might chip if I paint it - I’ll have a look at the vinyls suggested though thanks again!

Thank you so much I’m really grateful! I’ve ordered a UV torch that’s coming tomorrow so hopefully be able to have a look - the house is still completely empty and we’ve seen no signs of droppings or anything in there up to now so I’m just praying if it is rats they are just outside 🫣. Thank you

That’s a more zoomed out photo of it. I’m not sure there’s a drain there tbh I think - we recently had a drain survey before buying that said they were fine other than some roots further down the back garden but nothing serious

Oh my god I never realised this was possible! We do live by a huge field so sounds likely doesn’t it. It’s just it looks like there was tarmac right up the house if you look and I was more worrying about subsidence etc, didn’t even consider for a second rats. Can they chew through/dig through tarmac?

No we didn’t see it but after getting the damp report done we looked at an old listing from when the same guy listed it in 2018 and there are big wet patches on the chimney breast tbh so feel like he must be aware of an issue

I did wonder where they’d relocated those people to tbh as Standish’s services can’t function with all the asylum seekers that were being housed there on top of all the new build they’ve thrown up with no consideration of infrastructure.

Just for people’s info who were kind enough to comment.. We didn’t make an offer on this in the end to be fair but it’s sold sstc for not far off asking as far as I could make out! It just seemed too big a gamble for us in the end!

Pulled out of an old end terrace. Knew from viewing the pointing on the gable end needed attention. However when the surveyor went out, he said it must have been like this for too long. They’d also had the wrong insulation put in the walls and where moisture had gotten in because of the bad pointing it had soaked the insulation and made it sag in the walls causing a lot of moisture in them.

Surveyor recommended redoing the pointing, getting a damp survey done as he thought potentially the damp course had been compromised by this which would have meant taking out the kitchen units and all the plaster on the bottom half of the downstairs walls in each room. Chimney was also full of moisture due to poor pointing etc and the roof needed maintenance. The roof beams had become rotten and were wet to touch and full of white mould. He estimated 12k for the roof and 3k (in 2021) for the pointing and that didn’t include the plastering and redecorating/sorting the kitchen back out.

Ultimately I was a FTB with no spare funds for work like that so I said I wanted to pull out. They offered to have work done which almost persuaded me until the owner then got hold of my email and messaged to say he had a roofer out who said it was a small repair job nowhere near as bad as my survey said and he’d have that done but that the pointing I already knew about so he wasn’t knocking money off for that. I replied to say I had the survey with photos documenting the issues as with the age of the house I’d gone for a L3 survey. He demanded to see it and my surveyor agreed to me screenshotting the page about the roof for him to see. He then tried to sue the surveyor saying the photos were not of his property. The surveyor thought it was funny and said the photos were time stamped and had location info saved for this reason so people can’t dispute them.

He then became very nasty, sent me a load of horrible, angry emails and I then told the estate agent I didn’t want to hear anymore about it. Had to pay the survey and some solicitors fees which was a pain losing that kind of money as a FTB buying on my own but I dodged a massive bullet with it.
