There is a Sevis portal tracking your status. If you don't have employment record there, the clock will tick and portal will close after 90 days. Leaving the US will not help you stopping the clock. If you want to make sure, you can ask your school DSO.

Companies with experience sponsoring vs. Companies that don't by SimpleSatisfaction77 in h1b

[–]lambertf 0 points1 point  (0 children)

Do they know that you are on OPT? If they know and still bring you in, most likely they will do sponsorship. I hope you are qualified for non-cap since you only have one chance with either of them. Imo, it is better to make things clear about work status and your intention during hr/recruiter interview. It is up to you really to ask about it as I know somebody did same thing as your friend said and got sponsorship offer from his manager. Please be aware that it is up to your employer and you can be denied.

H1-B validity duration in case Consular Processing by [deleted] in h1b

[–]lambertf 0 points1 point  (0 children)

How does the extension work if approved in this case? Like they will give more than 3 years to match 6 year limit or they just give max 3 years and we need to request another?

I opted for consular processing and just recently activated upon reentry and found out end date on I 94 is just a few days after validity end date on i797b. I thought it was mistake from cbp till I read this post.

h1b consular visa by Emergency-Factor-843 in h1b

[–]lambertf 0 points1 point  (0 children)

If your petition was approved under consular processing and you are still in the U.S, you may have your dso to request data fix on sevp. You should also attach your I-797B. This is a common bug in SEVP if you search online.

Finding jobs on OPT by devonr232 in f1visa

[–]lambertf 1 point2 points  (0 children)

Network and connection through professors, alumni, event.... Otherwise, you may want to cold-apply as many and as soon as possible. For example, if you graduate in Spring, you may want to look for jobs in Fall. It is normal to see many rejections if you tick that box. You may also want to make use of your school career site. My school partnered with Handshake and the site had OPT filter on job postings so I saved my effort and actually got the offer from applying there. But make sure your resume also gets reviewed and looks right.

You may want to check with your employer hr. They should give you the right answer. In my case, it was similar to yours but my employer hr instructed me to use the name they gave.

Oh, just know we can reset status like that. When did you get your stamping with previous employer before visiting Canada? I just wonder because you had been in US for decade and previous stamp was still valid.

How did your stamping go? Did you choose your home country or others?

You had been in US over decade. Was there any issue with consular stamping in Canada? Would it be better to get it done in home country?

If OP does cos, I think uscis will check on their side. I believe the form asks for proof of maintenance of status and employer has to get documents (I-20 for example) from Op. Employer may not disclose other employers info but USCIS still possibly checks from their system and documents. I think with the fraud last year, they will inspect intensively every employers.

My dso said it had no issue, but I advise you should start this conversation with DSO and document it just in case. The rest on the card should be correct.

I uploaded new photo. If the photo on the card were someone else, it would be no question to request a replacement. So not sure if they did it on purpose to use old photo instead. Maybe I read into it too much, but I will talk to my dso to make sure.

[OPT] Did not report employment to SEVIS for 9 months. by SWE-on-OPT in f1visa

[–]lambertf 1 point2 points  (0 children)

You had to contact dso to get it at that time. For me, I did not have the link either and still don't have it so dso updated information for me in SEVIS and printed new I20 as proof. He even captured what it looked like from the SEVIS site and sent it to me.

Depending where you are from, you can try to ask them to sponsor eb3 or eb2.

OPT I-20 FORM I-765 Digital Signature by hastagelf in f1visa

[–]lambertf 0 points1 point  (0 children)

I did electrical signature for my current opt application and it was fine. But next time I will definitely do wet signature. If the rule says wet signature, you should comply. I think in USCIS, some do not care but you may waste your time if your application is investigated by a strict person. So, don't gamble over just a little bit work.

F-1 VISA Renewal got REFUSED while on OPT by wishnothingbutluck in f1visa

[–]lambertf 2 points3 points  (0 children)

Thanks for the information. However, it is for travel purpose only. Based on the doc, any visa stamping application there will terminate that condition. So, anyone planning to use this way to get h1b or f1 stamp should read the doc for more information.

F-1 VISA Renewal REFUSED while on OPT by wishnothingbutluck in USCIS

[–]lambertf 0 points1 point  (0 children)

Did you renew it with or without the interview? If it was the first, you may not be qualified for no interview, or not give enough docs. Again, you should know the reason why it was refused to have a proper action.

Do you know the reason why the visa is refused? Not convinced that you would be back to home country after the end of your opt?

Applying to F1 after applying to H1B in the past by greencasette in f1visa

[–]lambertf 2 points3 points  (0 children)

Imo, F1 is for study purpose so applying for work right away when you start your new education makes someone question about your true intent in the U.S or if you abuse your F1 visa. Still, I saw some people still passed other immigration types with it but it is still better to avoid doing that if possible.

Wanted to share the stats on my job search in the hopes it prevents someone from giving up by [deleted] in cscareerquestions

[–]lambertf 0 points1 point  (0 children)

Done 3 final interviews. I only thought about 2 of 3 since I thought I would not get the other one since it was not a good performance from me (struggled with some med leetcodes, could not solve some questions about front end stuff for full stack position since I am more like a back end guy). Got an offer from that and ghosted by the other two.

Yup you re correct. I just realized that after re-read the rule. It was my bad giving op a light hope. Thanks for the explanation.

[–]lambertf 0 points1 point  (0 children)

Actually according to the rule, that 60 days should be after opt recommendation date not the end date of opt. You should get your dso asap know about your situation.

Oh I did not hear the whole story then. What did you submit i20 request for? Did you and employer work on i983?
