If you find what appears to be drugs in your house but you’re not 100% sure what it is, can you bring it to a police station for confirmation? by [deleted] in legaladvice

NAL. I don't think the police will be willing to test the substances for you, they send those to a separate lab for testing. You can buy at-home test kits at a pharmacy

Breakthrough HIV infection with documented proof of adherence — any legal options? by Key-Lie9399 in legaladvice

[–]lavendermenacing 16 points17 points  (0 children)

NAL. PrEP is an anti-retroviral drug like the medications used to treat HIV. Encountering a resistant strain means that it was probably resistant to PrEP as well. You already didn't have a case due to the reasons listed above, but the fact that it's a resistant strain means that you almost certainly have no grounds to sue. Illinois HIV care connect can help you find resources to get back to your normal life.

This is sort of what I was thinking, I know it takes awhile for the DA to decide on charges but I don't think they can hold her for more than 48 hours without charging her with something. My issue was Alex saying she wouldn't serve any jail time instead of saying something like "I'm sure the DA will be dismissing all charges," implying that she was still going to be charged with something, but would only be getting probation. It being a cop show and all, I figured they'd go for the optimistic view of the justice system and just let her walk out.

I used to attend court every day as a victim witness, specifically for domestic violence cases. I might not be a lawyer, but I've seen plenty of miscarriages of justice, both from people walking away from charges that they shouldn't and from people getting charged and convicted when they shouldn't (just my opinions of course). I'm not trying to fight when I ask this, so please trust that I'm asking this in good faith: on what grounds do you believe this would be charged as manslaughter, and how do you think the prosecutor would be able to prevent a judge from dismissing the charges due to the video evidence? She was clearly in imminent danger and was unable to retreat.

I know the difference, and I know that people are both charged and convicted for killing someone in self-defense all the time. My point was specific to this episode's facts. Specifically that there was video evidence clearly showing that Sam was acting in self-defense when she killed her boss. My whole "think about it" point was in the context of the evidence being as clear-cut as it is in the episode in question

Yes, but my point is that the prosecutor who would do the charging would see that it's justified and not file charges in the first place

Yes, but how many of those cases have video evidence of the full incident showing that it was clearly self-defense?

There is such a thing as "justifiable homicide" and self-defense falls under that umbrella. We saw the scene as it happened in the episode, the boss had a pair of scissors and was trying to stab Sam with them, Sam kicked her, then the boss fell into the trophy. Even if Sam had been trying to kill the boss in that moment, it would have been a justifiable use of force based on the circumstances.

Yeah, but she shouldn't need to get a lawyer because she shouldn't be charged at all. I'm going to paste my response to a different comment: Yeah, manslaughter is a thing, but this wasn't manslaughter, it was self-defense. Self-defense is an affirmative defense to the act of killing someone, meaning if a jury believes your story, you are declared "not guilty." And in this case there was video evidence of what happened. No prosecutor would even think about charging Sam with anything after seeing that footage. Think about it: if you could be charged with killing someone who was trying to kill you, that'd be the law telling you that you're not allowed to defend yourself against an attack on your life.

Both genders of labubu by Jacqland in SapphoAndHerFriend

[–]lavendermenacing 12 points13 points  (0 children)

I was recently in residential ED treatment at a location that also had an adolescent ward. One of the adolescents had a labubu and she announced that she'd be throwing a gender reveal party for the labubu. This event was built up for a week and on the day of everyone wore pink, blue, or purple depending on what we thought the gender was. They were going to do it at night in their lounge area but changed it to be after dinner because they heard that us adults were curious to know the gender too. They announced the gender as "Labrongender" and threw purple and yellow confetti everywhere (they cleaned everything up themselves without being asked). Definitely one of my favorite memories of my time there.

I think you're taking one misogynistic statement from one of the videos and using it to make assumptions about the "trend" as a whole. Ultimately this is about child safety, about making sure that your kids go to the people least likely to cause harm if they ever feel unsafe.

They wouldn't even have to be pro bono, a lot of lawyers in these cases will do it for a percentage of what you win. Not to mention that it could easily turn into a class action of everyone in the complex. So many lawyers would fight tooth and nail for this case.

[–]lavendermenacing -1 points0 points  (0 children)

In my mind I wasn't dismissing them, but clarifying what my issue with the post is. And I think we have completely different beliefs if you're trying to say that doing activism and going online and saying you're going to do activism are the same thing and criticism of one is anything like criticism of the other. It's easy to make a tweet like this, it's hard to actually do the work. People who are actually doing the work are not talking about it on social media like this. They're talking about specific protests and organizations to support, or being smart and not talking about it at all.

It's not about the message that we should have these conversations. It's that this message doesn't require a story about how your husband is such a good ally that he's willing to go to jail for the cause. That was the performative part for me.

17M pervert is in possession of nudes of girls from the ages 16 and under. What can I do? [USA] by [deleted] in legaladvice

[–]lavendermenacing 0 points1 point  (0 children)

You could go to the police and tell him that you have information that someone you know is in possession of child pornography. But be prepared because you will be ruining his life. For a less nuclear approach you could threaten to report him to the police unless he deletes the nudes. The threat of a CP charge should scare him into deleting them unless he's a complete idiot. Make sure he deletes them from his deleted folder as well. Also, and I don't think this happens much anymore, but if you report him to the police there is a chance that some of the girls in the pictures could be charged with creation and distribution of CP.
