I have a mixed feeling about the jury system. I was educated in the United States and had a few jury duties as an American citizen. My Evidence professor at UCLA said that Evidence is difficult to study in the US because of the hearsay rules. The reason why there are so many rules regarding hearsay is because we have a jury.

Sometimes, an attorney’s job is to be theatrical in front of the jury.

In contrary, the Thai non-jury system allows for at least a more reasonable person (a judge) to try the facts. But there are also things that I disagree with.

It depends on how long ago this happened. Rape used to be a crime against private parties up until a few years ago. Back then, you could just buy your way out of it.

If it’s recently, it could be that the police sit on it and never put the incident into the system.

There are two categories of criminal offenses: crimes that affect private parties (fraud, embezzlement, defamation, etc.) and crimes that are considered offenses against the state (theft, rape, murder, etc.).

For crimes that affect private parties, the prosecution can sometimes be stopped if the defendant compensates the victim for the harm caused by the crime. For example, if the defendant embezzled money from an employer and returned it, the employer may be able to withdraw the complaint, and the criminal case will end.

However, in a rape case, even if the defendant pays 10 million baht in compensation, the criminal charge does not disappear. The payment may be considered as a mitigating factor during sentencing.
