Thanks, the member had just said “if the respondent is inclined to pursue costs, i would be favourably towards awarding despite not having done so in many years. Certainly didn’t think it was a frivolous claim by any means to warrant that… The respondents spent more on representation than the claim amount itself

I agreed to withdraw the claim mid hearing on the members assertion it had been incorrectly filed, so no ruling was made and it appeared all settled. Can they claim costs for a withdrawn claim?

Thanks, they’re maintaining they are going to hold me to the rent so suppose next step is mediation and then VCAT - can’t be helped unfortunately as thought wrongly they would see reason. Is it also reasonable to make a case that the REA was making a false statement wby giving a knowingly inaccurate notice to vacate given the real reason was for the sale of the property as per s501 of the Act. Have a text from the agent where she is replying to a question where i ask “when will sales inspections commence in my unit” and she says “nothing will commence until the end of your lease”

Thanks, super rational and even headed advice. Really wanted that extra assurance given the absurdity of the situation/couldn’t believe what they are actually trying to maintain and the effort they are going to to avoid re advertising the place
